Under the rule, eligible H-4 dependent spouses must file Form I-765, Application for Employment Authorization, with supporting evidence and the required $380 fee in order to obtain employment authorization and receive a Form I-766, Employment Authorization Document (EAD). USCIS will begin accepting applications on May 26, 2015. Once USCIS approves the Form I-765 and the H-4 dependent spouse receives an EAD, he or she may begin working in the United States.

I-765 Applicaiton form  --- > NOTE:  avesapadi akkada unna 765 form fill cheyakandi..because they are planning to post a new form revised for H4-EAD on 26th itself.

 

Fee ---> 380$  -  payable to U.S. Department of Homeland Security

 

On Question 16 of the form, you will need to enter (c)(26), which is the category for H-4 spouses.

 

Once you have filled out the I-765 application form, prepare the following supporting materials:

 

1. Evidence of lawful H-4 and H-1B status: Copies of I-94 Departure Records for you and your spouse,available at the Customs and Border Protection website, or copies of I-797 Approval Notices that have the I-94 Departure Records attached.
2. Copies of your and your spouse's passport data pages (photo page with the validity period).
3. Copy of your marriage certificate.
4. Copy of your spouse's (H-1B worker) green card process documents – meaning one of the following: a. I-797 Approval Notice for I-140 Immigrant Petition; b. Copy of I-797 Receipt Notice for I-140 Immigrant Petition that was submitted 365 days or more ago; or c. Copy of ETA Form 9089, Application for Alien Employment Certification (also called a "Labor Certification Application" or "PERM Application"), which was submitted 365 days or more ago.
5. Copies of three recent paychecks to evidence that your H-1B spouse is working and being paid and thereby maintaining lawful H-1B status.
6. If your H-1B spouse does not have an I-140 Approval Notice and is using a copy of an I-140 Receipt Notice or Labor Certification Application, a complete list of dates that your H-1B spouse has been in the United States, with copies of all available supporting documents, such as passport entry/departure stamps, airline boarding passes, or U.S. Customs and Border travel history, which is available at the above website for the I-94 Departure Record
7. Two recent color passport-sized photos.
