counties best way to know if ammendment needed 

fyi - counties are different from Metropolitan Statistical Area(MSA). Two MSA can be in same county sometimes. So we have to be careful

kaani vadu aa statement lo from one client site to another annadu...ikkada site ante "office location" or is it actually changing entirely to a diff client anedhi pedda q...

Bro i am familier with the process msa ante if your client office location changed and its within the same county region(MSA) then you w need not file new LCA or amendment you just need to update the LCA anthe.....but if you change to new client within the same county then you need to amendment since your changing your client office location does not matter here........

Bro i am familier with the process msa ante if your client office location changed and its within the same county region(MSA) then you w need not file new LCA or amendment you just need to update the LCA anthe.....but if you change to new client within the same county then you need to amendment since your changing your client office location does not matter here........

this is what I got from my employer

Amendment of H1B Petition would not apply:

1. If the new work location is within the same metropolitan statistical area (MSA) or an “area of intended employment” covered by the existing approved H-1B petition. If the H-1B employee is moving to a new job location within the same MSA or area of intended employment a new LCA is not required. Therefore, the employer does not need to file an amended H-1B petition.

2. Short term placement : This would not apply when an H-1B employee is placed at a new job location for up to 30 days, and in some cases 60 days (where the employee is still based at the original location), without obtaining a new LCA.

3. Non-worksite locations: Also, if H-1B employee is only going to a non-worksite location, the employer does not need to file an amended H-1B petition. A location is considered to be “non-worksite” if the H-1B employees are going to a location to participate in employee developmental activity, such as management conferences and staff seminars, where the H-1B employees spend little time at any one location; or the job is “peripatetic in nature,” such as situations where their primary job is at one location but they occasionally travel for short periods to other locations “on a casual, short-term basis, which can be recurring but not excessive (i.e., not exceeding five consecutive workdays for any one visit by a peripatetic worker, or 10 consecutive workdays for any one visit by a worker who spends most work time at one location and travels occasionally to other locations).”

same Metropolitan Statistical Area(MSA) - which is nothing but the City Limits.

 

Even if you change client and within MSA then no need of Amendment and even same  client different MSA you have to amend H1. Like my case from Oklahoma to Texas- same client but I have to amend H1 Bhayya

+1... Instead of Clients.. its Based on MSAs...

guys naadi WFH job, NC/CA 2 address lu petti LCA cheysam so ippudu nenu NC lo addres change aina or verey state ki move aina with same client same vendor same emp .. emaina cheypinchalaa? changes in LCA or H1 amendment laantivi??

LCA update cheyu saripothadi bro, in your case nothing like " Material Change" so you should be good. Amendment anedi only for "Material Change" ki

bro nenu 2013 lo H1 approve ayyinappudu client location (ND) lo vunde vaadini.. LCA lo primary location client address, secondary location employer address pettaru..ippudu nenu same client ki chestunna but from employer location (working remotely and employer vunna location lo ne vuntunna)..so nen amendment cheyyala..?

When You Do NOT Need to File an Amended Petition

  • A move within an MSA: If your H-1B employee is moving to a new job location within the same MSA or area of intended employment a new LCA is not required. Therefore, you do not need to file an amended H-1B petition. However, you must still post the original LCA in the new work location within the same MSA or area of intended employment. For example, an H-1B employee moving to a new job location within the New York City MSA (NYC) would not trigger the need for a new LCA, but you would still need to post the previously obtained LCA at the new work location. This is required regardless of whether an entire office moved from one location to another within NYC or if just one H-1B employee moves from one client site to another within NYC.
