dotnetrockz Posted June 20, 2015 Report Posted June 20, 2015 the answer is self explainatory :) Is there a necessity for working with the company that has made the I-140 filing for a minimum period (6 months?) before which one can port his I-140 to another company? Attorney The I-140 does not get ported to a new company. The I-140 employer petition is company specific. The exception to this is in a case where there is a sufficient connection between the companies OR the I-485 has been filed / pending for at least 180 days. Otherwise, the priority date generally can be retained from the approved I-140 in a new I-140 filing. But, it is ONLY the priority date that is kept, not the rest of the case. (15.Jun.2015)
abhigadu Posted June 20, 2015 Report Posted June 20, 2015 Only date port chesukovochu but still ur new company has to file i140 again..
vasu123 Posted June 20, 2015 Report Posted June 20, 2015 GP. 180 days anedi 485 (adjustment of status) apply chesaka 140 port chesukovadaniki. 'Similarly, there is nothing we can do if your previous employer choses to withdraw the I-140. The I-140 is the employer’s petition. However, regardless of whether your previous employer withdraws the I-140, you are able to retain your priority date. You can use that same priority date even if a new employer files a labor certification application on your behalf.' This was my attorney's answer to the same Q i have asked them .
changure Posted June 20, 2015 Report Posted June 20, 2015 Guys, There is no such rule of 180 days for the I-140 .Ones the PD is established and I 140 is approved, the PD belongs to the person . the only other case where you cannot retain your PD is under willful misrepresentation or the Fraud identified by USCIS. Note: The employer can only withdrawI-140, USCIS will revoke it .
