You cannot, H1b is only for you to work for specific employer. The moment you quit job you are out of status and have to leave the country. But if you have more than $500K in investment you can seek investor visa or GC and start restaurant. You will have to invest the monies and create a certain number of full time jobs. Good Luck

Your best bet is to talk to your current h1b holder and continue running payroll. You need to Pay that employer to keep running it.

Also, on h1b, you can own a business or a company...but cannot work for it on paper. But you can work under the table ...gap chup....but a risk if someone reports it.

 

When i say you cannot work for the company, but you can own it on H1b...it means, you can be the owner and take the profits and file taxes. You cannot work for it means...cannot do any admin work or even cleaning the tables etc etc.....

 

In short, you have to manage it "Gup Chup" till you get married and spouse has i140 approved, then EAD and you can do raccha. So plan this from now....i mean marriage too with a working girl in USA.
