Please advise on the below H4 EAD questions and the answers, no guess work pls, any links from google thalli are fine.

 

Question 1. What needs to be done/happen, to fall back on the old H1B in future? Does employer need to maintain my i140? Does the H1b also need to be kept open by ex employer? Will it have to go under quota gain?

 

Answer: Yes, One can fall back on H1b from H4 EAD based on Previous H1b. It will not be under quota. If 6 years previuosly already done on h1b , then I 140 needs to be live i.e. not revoked by the employer.

 

 

Question 2. Is there an Advance Parole that can be applied with H4 EAD, if yes how many years is the AP and EAD granted for H4 EAD? Or for H4 EAD, you travel on H4 visa.

Question 3. Is H4 EAD status same as EAD status applied with i485? Can any USA employer have a internal advertised policy on not hiring H4 EAD and preferring i485 EAD?

Question 4. Is it mentioned on the EAD card that this is an H4 EAD.

Question 5. Also Is there any diff between H4 EAD and EAD based on i485.

A freind has option to convert onto H4 EAD, he already has his i140 approved and wating for PD to be current, but got FTE offers now, so he is thinking to convert as his Spouse also on H1b and I140 approved. If he waits futher, New H1b from October and H4 EAD will flood the marjet and opening will be less.

 

So asked these questions.
