This might increase the EAD H4 approval time beyond 90 days as mentioned on several news letters. 5. Once H1B to H4 change of status is approved the beneficiary cannot continue to work effective from the date mentioned as the start date on the H4 I-797. Now the concern that most of you have is how to go about this conversion seamlessly without any employment gap or minimal employment gap possible. One thing I found on a forum is that while applying for H1B to H4 change of status we can mention the effective date of when we want the H4 status to kick in. I am not sure how true this is. Assuming it is correct then the beneficiary can apply for H1B to H4 change of status concurrently with EAD H4 with effective date of H4 being 90 days from current date of application. Even after the change of status is approved the beneficiary can continue working on H1B uninterrupted till the H4 effective date kicks in. Hopefully by then the H4 EAD is also approved and hence no employment gap is achieved. "

krishna0125 Posted August 17, 2015 Report Posted August 17, 2015 Yes you can apply h4 and h4 ead simultaneously. You should stop working once your h4 is approved and again you can start working once h4-ead is approved. Your h4-ead will be kept in hold until your h4 gets approved first. So you may have like few weeks or a month dealy in work with all this process. But you can work atleast 2 months after applying for h4. And h4- ead as now a days it's take min 3 months
