A division bench of the High Court at Hyderabad comprising Acting Chief Justice D.B. Bhosale and Justice S. V. Bhatt on Thursday passed interim orders permitting the AP Intermediate Board to operate the bank account at State Bank of India MJ Market branch subject to the condition that the balance amount which was available as on date of request made by the Secretary, Telangana Intermediate Board, is maintained.

The bench passed these orders as interim measure in the writ petition filed by AP Intermediate Board through its secretary M.V. Satyanarayana . He complained that the account in State Bank of India, MJ Market branch, Hyderabad, had been frozen at the instance of Secretary, Telangana Intermediate Board, on Thursday

The bench heard the arguments submitted by P.Venugopal, Advocate General, AP state, and K. Ramakrishna Reddy, Advocate General for Telangana state. Mr Venugopal pointed out that when there was division of assets of erstwhile undivided AP Intermediate Board the action of the Secretary, Telangana board asking the bank to freeze the accounts was not correct.

Mr Ramkrishna Reddy said that as per the provisions of the Reorganisation Act and the judgment rendered in the case of State Council for Higher Education, all the institutions which were mentioned in the Tenth Schedule of the act were under the control of state in which they were situated. The Intermediate board was in Hyderabad and thus the Telangana would get all the assets and AP could not ask for share in the money.

He lamented that major portion of the money from the account had already been transferred to Vijayawada. He said that the Telangana government had taken steps to challenge this transfer and now the AP filed this writ petition to pre-empt the case to be file by Telangana. The bench asked both sides to complete the pleadings and adjourned the case to September 10.

HYDERABAD:In a temporary relief to the Board of Intermediate education of AP state (APBIE), a division bench of Hyderabad High Court on Thursday permitted the AP Board to operate its account in the State Bank of India at MJ Market branch of the city, subject to the condition that the balance amount which was available as on the date of freezing of account is maintained.

The bench comprising Acting Chief Justice Dilip B Bhosale and Justice S V Bhatt was passing these interim orders in a petition filed by the APBIE challenging the action of Board of Intermediate Education of Telangana (TBIE) in seeking the bank to freeze its accounts. The bench earlier pulled up the secretary of Telangana Board and the SBI over freezing the account.

While granting the relief, the bench directed the AP Board that it shall maintain balance of amount which was available on the date of freezing the accounts.

Advocate general of AP state P Venugopal urged the court to allow the APBIE to operate the accounts as the action of the TBIE and the Bank was without any authority or law.

The bench said that it would grant permission to operate the accounts only if the AP AG makes a statement that the Board will not withdraw the amounts which are available on the date of freezing of the accounts.

While opposing grant of interim order, Advocate General of Telangana state K Ramakrishna Reddy contended that there was no agreement for distribution of assets and liabilities between both the boards and the act of the APBIE in transferring Rs 105 crore to Vijayawada was illegal.

As for the APBIE’s claim that it has opened separate accounts as per the minutes of the meetings held between the officers of both the states for distribution of assets and liabilities of the erstwhile board, the AG termed them as false and baseless, and that the accounts were opened even before bifurcation of the state.

Ramakrishna Reddy further said that as per the provisions of the AP Reorganization Act and the judgment rendered in the case of AP State Council for Higher Education, all the institutions which are mentioned in the 10th Schedule of the Act are under the control of Telangana state in which they are situated.

Accordingly, Telangana gets all the assets of the Intermediate Board which is in Hyderabad and the AP state cannot ask for a share in the money of the boards account, he said. While posting the matter to Sept 10 for further hearing, the bench directed the Telangana government to file the implead petition in the case and also the counter affidavit by next hearing.
