Hello,

 
I know many of you are writing to ask us about the possibility that the federal court is going to cancel the STEM 17-month extension.  This is the latest information I have received about the case:
 

A federal court held yesterday that the 2008 rule that created the 17 month STEM OPT extension was improperly issued. The court said that the USCIS failed to obtain required “notice and comment” from the public before issuing the rule. However, fortunately, rather than immediately invalidating the STEM OPT extension, the court “stayed” its decision until February 12, 2016 so that DHS would have time to submit the rule for proper notice and comment.  Presumably there will be no change to STEM OPT, 

 

The discussion I am hearing is that it is likely the court will not rule negatively; however, we won't know for sure until the final decision is made on February 12, 2016.

My guess  ... No issues .....USCIS will handle it  ...

they will remove it i guess but for people who have already started the STEM extension might not be effected by this change...
