k2s Posted September 12, 2015 Report Posted September 12, 2015 09/08/2015: Amazing Power and Efforts of STEM OPT Stakeholders to Push for New Rule-Making Process Expeditiously During the holiday weekend, there were massive STEM OPT stakeholders using their electronic tools to sign the petition to the White House to initiate the new rule-making process expeditiously. It is expected that the magic number of required signatures will reach 100,000 today. We hope that the STEM OPT stakeholders to see the fruits of their tireless efforts to motivate Obama Administration to launch the rule-making process expeditiously. We, however, reported lately that there were wrinkles developed after the court decision invaliding STEM OPT rule effective 02/12/2016. The group that brought the lawsuit wanted to go further than invalidation of the rule on the grounds of alleged procedural errors in the rule making process for this program. They filed an appeal to the U.S. Court of Appeals in the DC Circuit seeking overrule of the decision of the District Court judge who implicitly recognized the legal authority of the Executive Branch to implement such program without legislation. This issue becomes an hotter issue in immigration areas by another development, the loser of the H-4 EAD litigation challenging the DC District Court judge's decision on another ground. These two groups for two different immigration programs started a fight against the root of the authority of the Obama Administration to implement such immigration programs without legislations. Their winning chances may be dubious at the best, but these developments remain unresolved wrinkes to Obama Administration's efforts to reform immigration programs without legislation. Considering the fact that the result of these litigations will impact other pending legal immigration reform programs of the Obama Administration.
