I140 Ead...not For Everyone With I140

09/09/2015: "Acceptance" or "Filing" Cutoff is Not Just I-140 EAD

• AILA has released its analysis of the new Visa Bulletin of October 2015. There are many people who are confused this Visa Bulletin reform as I-140/EAD reform. It is rather "pre-registration" of EB-485 applications when their priority date is "earlier" than the second-track of cutoff date named filing or acceptance cutoff dates. AILA review thus indicates that inasmuch as it is a regular EB-485 application, many benefits to this type of application may also be available, including, but not limited to, concurrent filing of EAD and Travel document, portability of approved I-140 (change of employment) after 180 days of filing, etc. Unlike the other traditional track of visa cutoff date in the Visa Bulletin, pre-registration EB-485 will not be adjudicated and approved until the final approval track cutoff date becomes available for one's priority date. It is hopedthat the USCIS releases some FAQs or even schedule a teleconference on this change soon. For now, we extend our congratulations to the foreign professionals who have been suffering from the long delays before they could file EB-485 applications, not to mention approval of the EB-485 applications.

 

 

I understand that Oct bulletin eb2 cutoff date changed to jul 1' 2011. kaani chaala mandhi who had their I140 approved, are waiting for I140 ead rule from govt so that they can proceed with EAD applicaiton with out having their priority date to become current. but paina para lo I140 EAD rule asalu consider cheyyaledu and still saying that, only those whose pd's are current before 1 jul 2011 can apply for 485 process.

Many People thought DOS/USCIS will be new category created (namely: 1-140 for EAD or I-140 EAD) for all people with their 140's approved and Dates are not current yet .

 

But October Bulletin didn't create any new such category instead it allowed to "Pre-Register " i.e apply for i-485(AOS) and EAD's

yesterday vachina bulletin lo ...after i140 approval....through acceptance date chusi EAD istharu...

 

don't get confused with other proposal of direct EAD after i140 approval....ani telling akkada....

so mothaniki 'I140 EAD' affect loki vachindhi but andarki varthinchadhu....as it allows only those candidates whose cutoff dates are earlier to 1 jul 2011. Regular cutoff table lo May 2005 ani undhi priority date. but early acceptance table lo 1 jul 2011 ani undhi...

 

people with pd's after jul 2011 should wait in the line and rely on the updates posted to early acceptance cutoff date table and move forward with I485 process..
