H4-Ead Apply Chesina Vallu -Please Advise/help

Nenu H4 EAD application fill chestunna -for my wife. Currently she is in H4 status-H4 december lo expiring.So now we want to apply H4 EAD.  I have I-140 approved. I am following link : http://www.uscis.gov/working-united-states/temporary-workers/employment-authorization-certain-h-4-dependent-spouses

 

I have few doubts: apply chesina vallu koncham clarify cheyyandi

 

1. Form I-765 to patu manam Form I-539 kuda fill Cheyyala? (form lo edo change of status ani undi so asking)

 

2. This point artham kaledu naku (see below) : Do i have to submit the labor perm application copy also? 

• Based on Filing of a Permanent Labor Certification Application. Submit evidence that the H-1B nonimmigrant is the beneficiary of a Permanent Labor Certification Application that was filed at least 365 days prior to the expiration of the six-year limitation of stay. You may show this by submitting a copy of a print out from the Department of Labor’s (DOL’s) website or other correspondence from DOL showing the status of the H-1B nonimmigrant’s Permanent Labor Certification Application. If DOL certified the Permanent Labor Certification, also submit a copy of Form I-797 Notice of Receipt for Form I-140 establishing that the Form I-140 was filed within 180 days of DOL certifying the Permanent Labor Certification;

               OR

• Based on a Pending Form I-140. If the preference category sought for the H-1B nonimmigrant does not require a Permanent Labor Certification Application with DOL, submit evidence that the H-1B nonimmigrant’s Form I-140 was filed at least 365 days prior to the expiration of the six-year limitation of stay and remains pending. You may show this by submitting a copy of the Form I-797 Notice of Receipt for Form I-140.

H4 december lo expire avutunda? December varakune isthademo EAD. Ippudu apply chesthe 3 months minimum padutundi for approval unless you are applying along with premium H1B extension.

THis is not valid if you have approved I-140.

It does not apply if your 140 is approved (it if for people who are in US for >6 years and their 140 is pending approval) . If you can submit a copy of I-140 approval, that should be all.

No man , Na H1b EXTENSION AYYINDI BUT IPPUDU I WANT TO APPLY H4- ead INSTEAD OF EXTENDING H4

first things first....

 

December lo H4 expire avutunte....dont apply for EAD....adi radanike 3-4months padtundi.....better renew ur H4 and apply..

 

Application ki vaste...neeku 140 approved kada....dani copy unte...adi pettu..no need of filing the 539 form.

 

incase me employer neeku 140 approval notice ivvaledu ante..number aina kanukko...a number fill cheyi..and ask him a letter that he will not give the approval notice...

 

 

this will work...

 

but again as i said..ippudu apply chesi waste..wait for renewal...and then apply
