11/20/2015: 140 EAD/Portability Reform Involves Two Proposed Rules Both of Which Are Under Review by OMB Now

• As we reported earlier, the USCIS requested the OMB to review and approve their proposed rule on 09/25/2015 for amending 140 portability rule (204(j)) changing the definition of "same or similar occupation" for I-140 portability, which is also part of AC 21 legislation. The second rule which is also a proposed rule and is submitted to the OMB for their review and approval yesterday is the modernization of employment-based system allowing those with approved I-140 approval can change employer and granting EAD. Combination of these two rules will reform current AC-21 regulation as well as EAD rules in the immigration regulations allowing portability and EAD applications. It appears that the USCIS has been coordinating the timing of these two proposed rules carefully in that 140 portability rule was presented to the OMB on 09/25/2015 as not, repeat not, an economically important rule, while now the second proposed rule of modernization of employment-based immigration system reform which was just submitted yesterday to the OMB was presented as an economically important rule, such that two rules may be probably completed in about same or similar time. We thus hope to see that both of these two proposed rules be released in December 2015 or soon after that. For these two pending proposed rules, please click here.
