FAQ on #I140EADAP Rule What is I140EAD-AP rule?

on Nov 20, 2014 The President Obama announced key actions via Executive Order to address the immigration issues. There were two important pieces for the skilled immigrant community, which will impact mostly Indians and Chinese born and stuck in the GC Backlog. One was H4EAD and the second one was Job mobility and travel documents for the people stuck in long backlog.

I140EADAP

I140EADAP is the terms used by us, the skilled immigrant community. You’ll not see this term outside our campaigns like Tweets, emails, and conversations. This is not a single rule, rather three pieces. 1. 1615-ZB44 2.1615-AB97 3. 1615-AC05 [click on the links to see the proposed rule abstract]

1615-ZB44 — Provides clarification on ‘same or similar job’ for the purpose of job portability or mobility (Though sounds similar, there is a catch, we’ll know more about this in Dec). This is approved by OMB open for public comments.Link Here Right now this is released as a policy memo.

1615-AB97 — This is about clarifying certain AC21 interpretations. Content of this rule is with OMB for review.

1615-AC05 — This is the key part. This is the rule submitted to OMB review on 11/20. I believe AB97 content is included in this.

Why is this rule important?

Last time magnitude of these changes have happened were 15 years before via AC21 [American Competitiveness in the Twenty-First Century Act of 2000]. AC21 lets us extend H1B beyond 6th year and many other benefits. Yes, there were a time wherein you cannot extend the H1B beyond 6th year. We may never see the magnitude of these changes in a decade or so. It is very important that we as a community stand together, stand tall. This point in time is very crucial, there may not be another chance.

How does I140EADAP benefit us?

There are a few key benefits, several derivative benefits are associated with it. Again, these are our asks and demands. Since we haven’t seen the rule text in its entirety we do not know what it contains, how the changes will be achieved.

1. EAD & AOS immediately after I140 is approved. This will let you apply for Adjustment of Status (AOS) and Obtain Employment Authorization Document (EAD), without needing to maintain H1B status.
2. I140 Irrevocable. This will make sure even if your employer revokes I140, you can retain your spot in the GC line
3. Change jobs without the fear of losing your I140 and spot in the GC line. The EAD, I140 irrevocable clause combined with broader ‘same or similar job’ interpretation will help you to work for any employer.
4. You might be able to accept promotions, earn a fair wage, learn new technologies and explore new avenues.
5. Your dependent kids will get EAD as well. This is a huge deal specifically for the people with teenage and college going kids. They can get instate tuition benefits. You pay a huge amount in tax, stay in the state for a long time and it is fair to get instate tution fees. Under the current system, even if you have stayed instate for 10 years, your kids wouldn’t be eligible to get instate tuition benefits.
6. AP — Advance Parole. Visa stamping has been a nuisance is an understatement. Missed marriages, funerals, haven’t met families, parents in the fear of visa rejection could be the past. The travel document or AP will let you freely travel in and out of the country.

Action Items:

1. We have to submit comments for ‘Same or Similar job clarification’ memo. USCIS has invited for comments for this rule until 01/04/2016. Details will follow on this
2. We will wait for OMB to approve the second & third rule. Meanwhile we keep pressure on the agencies via mail, email, tweets to make it faster and include what we want.
