Generally if you apply for transfer after the expiry.. max 90% they may ask you to go to of country for stamping.

Second one applied on Nov 13

as second h1 applied after first expiry and under extension, you have to wait till your first h1 ext approved for your second h1 transfer to start.

Chala tricky situation.. General ga date ayipoyina if we are in extn .. we can stay until that case got approved( 240 days anukunta period idhi).. but in that grace period.. if you apply for H1 Transfer.. you must have give the old i94 which is already expired.. Means there is a issue with status..  Please check with attorney bro once..

These are the summarized timelines.

1)Applied H1B extension with employer A on Sept 1st.

2)Issued RFE on Sept 15th because my project was going to be ended on sept 30.So USCIS was asking me whether project going to be extended or not.

3)H1B expired on Sept 30th.

4)Since my project got ended and no way that it was going to be extended ,I decided to file a new petition with employer B.

5)Filed a new petition with B on Nov 13th.

6)Issued RFE for the petition with employer B asking whether I was on legal status between my H1B expired on Sept 30 and my new H1B petition filed on Nov 13th.

7) I answered the RFE today for the petition with B saying that my current employer A is still waiting for the decision be made from USCIS and RFE with A still in pending status.

 

Questions:

        1)In order to get my H1B petition with employer B approved ,do I need to get petition with employer A approved or petition with B can be approved while petition with A is in pending?

2)Since date for initial RFE issued with A is approaching(Dec 10th) and if it gets rejected since I have no plan to answer this, does it affect the outcome of petition with B since the bridge here is broken as I applied 2nd petition based on pending petition with A?

no he is still in status as first h1 is under process and receipt # generated before expiry..... he is good sodara

man company B transfer is based on Company A approval...so eppudu company A rfe ki reply ivvali  and automatically B transfer depends on A (if I understand your situation correctly)

H1 ext from emp A should be approved 1st by USCIS. then only they will have transfer of h1 to emp B. 

by mistake of USCIS and by luck of ur frnd... emp B h1 approve iyyipothe... then they will ask to get out of country n come back again on new i 94

atleast request that company or an attorney to draft a letter stating the same. 

xxx time ninchi yyy time daka candidate is with employer A ---- ani letter raasi... from emp a or from attorney and submit it as reply to RFE of campany A. 

 

appudu USCIS will consider and approve the the initial 1 or atleast the later 1.
