Scenario:

- h1 holder has an approved i-140 through emplyr A

- applied for h4 EAD for his wife.

- after applying for h4 ead (not yet approved) he now applies for h1/h4 transfer to emplyr B.

- emplyr A terminates old h1.

- gets an regular rfe on h1 transfer/extn requesting client lettr.

- After responding to rfe gets  h1, h4 and h4ead approved.

 

Question:

Can we apply h4 ead on previous employers i-140 while employed with new emplyr?

 

Answer:

from above personal experience the answer is yes..

yes as long as ur i140 is still active and employer did not revoke it.

As long as he has an active I140. EAD is valid..As sosn as I140 revoked EAD goes invalid..

1. I 140 revoked by USCIS 

      USCIS vaadu revoke chesthe inka cheyseydi emi ledu. new perm with new PD and again new i140. USCIS will revoke if employer/company is getting closed, have more audits, fraud etc. 

 

2. I 140 revoked by Employer (some times we can as withdraw) but actual ga ithe after approval withdraw ani anaru  only revokeed by USCIS or revoked by employer. 

     Employers kontha mandi new  perm/i140s file cheyyadaniki, ex employees approved i 140 untey vatini revoke chestharu. so that they wont get any audits by USCIS with the company profits, employees number, pending cases etc etc. 

 

ala employer revoke chesthe matuku we can still use the same PD when filing new perm n i140 with new employer. 

 

n nuvvu adigana ques ki matuku.... 

I140 should be valid and active if  u want to use H4 EAD. paatha employer 140 revoke cheysinapudu h4 ead is not valid untill new emplyer 140 is approved.

CMPNYA nunchi CMPNYB ki marinapudu CMPNYA vadu I-140 ni revoke chestadu kada baa (not sure if its called revoked or withdrawn)...appudu with in wht time frame CMPNYB has to file for PERM to get the PD retained?

time frame tho em pani ledu. company a vadu revoke cheyseydapudu will inform USCIS why he is revoking. like ex employee ani 

so after 1 month or after 1 yr also u can use that same PD date. 

 

job role n responsibilities matuku change avvakudadhu... they should be similar.
