Eligible individuals include certain H-4 dependent spouses of H-1B nonimmigrants who: • Are the principal beneficiaries of an approved Form I-140, Immigrant Petition for Alien Worker; or • Have been granted H-1B status under sections 106(a) and ( B) of the American competitiveness in the Twenty-first Century Act of 2000 as amended by the 21st Century Department of Justice Appropriations Authorization Act. The Act permits H-1B nonimmigrants seeking lawful permanent residence to work and remain in the United States beyond the six-year limit on their H-1B status. Frequently Asked Questions: Question: When can I file for an H-4 EAD? Answer: Anytime on or after May 26, 2015. Applications received before that date will be denied. Question: Can I file for both change of status to H-4 and an EAD at the same time? Answer: Yes. Question: What is the filing fee for an EAD? Answer: The same as any other EAD - $380. Question: What do you charge for filing an H-4 EAD? Answer: Our attorney fees are; $170. Question: How much time will I get? Answer: That is not yet known. Almost certainly, the EAD will be approved only through the expiration date of the H-1B petition. Question: How early may I apply for an extension of my H-4 EAD? Answer: You will need to attach the following: • Proof that you are in lawful status (I-94) • Proof that you are married to an H-1B (marriage certificate) • Proof that the H-1B is in lawful status (I-94, I-797 approval notice, and pay stubs) Other asked Questions: Question: Once my spouse applies for their H4 EAD, will they be able to work once they receive their receipt notice or do they have to wait till a decision has been made by USCIS and they issue a card (like in H1B)? Answer: Your spouse may not work until she actually receives the EAD card. Question: Is it mandatory for H4 EAD holder to have a job waiting for them to file and if they don’t have a job waiting, are they required to work on their H4 EAD? Answer: No, she may apply for an EAD without a job offer and then decide whether to work after they receive their card. Question: If my spouse doesn't get any Job in 4-5 months (or is there any time limit?), do we need to apply for change of status back to H4, or can she be in EAD even without Job? Answer: No, if she doesn’t work, she will just be an H4 with work authorization. The EAD allows her to work if she wishes, but doesn’t require her to work. Question: Once my spouse receives their H4 EAD, do we need to apply for her SSN or only after she get the Job need to apply? Answer: It would be a good idea to get the SSN when she gets the card. She won’t be able to start working until she has an SSN. gp
