12/23/2015: Hooray! OMB Approved I-140 EAD/Portability Proposed Rule on 12/22/2015

Stay tuned to this website for the text of the proposed rule. On behalf of the I-140 employers and foreign workers, we wish to send our thumbs up to the leaders of the USCIS for handling the rule-making process timely, despite the threat by the U.S. Senate Judiciary Committee Chairman, Chuck Grassley, against this rule-making process of the USCIS.
Stakeholders of this rule are encouraged to send in positive comments once this proposed rule is published in the federal register with a period of comments. This involves a rule-making process and not related to Congress. Stakeholders should stay away from unnecessary contacts with the legislators on this rule-making process, stirring unnecessary political controversies in the national election year. Stakeholders on the part of the federal government are the White House and the DHS/USCIS.

There are a few key benefits, several derivative benefits are associated with it. Again, these are our asks and demands. Since we haven’t seen the rule text in its entirety we do not know what it contains, how the changes will be achieved.

  1. EAD & AOS immediately after I140 is approved. This will let you apply for Adjustment of Status (AOS) and Obtain Employment Authorization Document (EAD), without needing to maintain H1B status.
  2. I140 Irrevocable. This will make sure even if your employer revokes I140, you can retain your spot in the GC line
  3. Change jobs without the fear of losing your I140 and spot in the GC line. The EAD, I140 irrevocable clause combined with broader ‘same or similar job’ interpretation will help you to work for any employer.
  4. You might be able to accept promotions, earn a fair wage, learn new technologies and explore new avenues.
  5. Your dependent kids will get EAD as well. This is a huge deal specifically for the people with teenage and college going kids. They can get instate tuition benefits. You pay a huge amount in tax, stay in the state for a long time and it is fair to get instate tution fees. Under the current system, even if you have stayed instate for 10 years, your kids wouldn’t be eligible to get instate tuition benefits.
  6. AP — Advance Parole. Visa stamping has been a nuisance is an understatement. Missed marriages, funerals, haven’t met families, parents in the fear of visa rejection could be the past. The travel document or AP will let you freely travel in and out of the country.

Action Items:

  1. We have to submit comments for ‘Same or Similar job clarification’ memo. USCIS has invited for comments for this rule until 01/04/2016. Details will follow on this
  2. We will wait for OMB to approve the second & third rule. Meanwhile we keep pressure on the agencies via mail, email, tweets to make it faster and include what we want.
