Job Portability Prior To I-485 Filing May Be Coming Soon

We may have some new insight into the Department of Homeland Security’s plans to provide job portability to those with an approved I-140 but who cannot file the I-485 because the priority date is not current based on the OMB review of the I-485 form. When an agency wants to update a form (also known as an “Information Collection”) they must submit it to the OMB. You will see in the top right corner of any immigration form, that there is an OMB No. and an expiration date. Earlier this month, the Department of Homeland Security submitted a statement to OMB explaining the changes it intends to make on the I-485 form. In this statement, DHS indicates that it wants to include a new “supplement J” to the form to allow an I-485 applicant to “request job portability to a new, full-time, permanent job offer that you intend to accept once your Form I-485 is approved.”

As I have explained previously, when an I-485 application is filed based on an approved I-140, one of the required documents to be submitted is a letter from the employer that filed the I-140 petition confirming that the employer still intends to hire the applicant in the same position mentioned on the labor certification and I-140 petition.

Now, instead of a letter, it appears that USCIS is intending to have the employer sign a new section of the I-485 form. The twist is that the form gives the option for the I-485 applicant to have a NEW employer sign. It appears that DHS is using  INA Section 212(a)(5)(A)(iv) to say that the labor certification remains valid if the requirements of AC-21 are met. This is expected to be part of the overall executive action plan which would help ease the transition to permanent residence for those stuck in backlogs.

The Agency Submission indicates that it is associated with RIN 1615-AC05 and it was submitted to the Office of Information and Regulatory Affairs on December 10th.
