zustrelaax Posted December 29, 2015 Report Posted December 29, 2015 Most are confused about the i140 EAD rule, here is the summaryCorrect me if i am wrong :1) Once 140 is approved, applicant may have to wait for one year.2) Applicant can apply for EAD based on 140 approval If there is a (or recently was) Compelling Circumstance - Change of Role/Promotion/Employer/Office location/transfer etc which would trigger another Perm/140 application3) EAD will be approved (solely by USCIS) for 3 years or End of H1/L1 i797 validity (not sure which one applies).4) Applicant can continue to change jobs but expected to maintain H1 Status (NA for L1 as they work with same Employer ???? but need to maintain L1 status of Visa/re-enrty)5) If Current EAD's is approaching expiry, one can extend only if the PD is one year away or else not possible6) But, another NEW EAD can be applied if we come across another Compelling Circumstance.So this is actually not a dead lock situation and there is a ray of hope !!Better than what we have today provided points no 2) & 6) come out to be true.At this point of time, its very important for us to be united and be patient how we were/are always.We must give true comments during the comment period and get this rule approved so that there is some kind of peace.
