Second Circuit in New York City ruled that  hat USCIS must provide notice of its intent to revoke an immigrant visa petition to those who actually will be affected by the revocation

 

 

 

01/08/2016: Court Ruled that the USCIS "MUST" Give a Prior Notice of Intent to Revoke to the Affected Parties Before Visa Petition Revocation

• The American Immigration Council reports that the U.S. Court of Appeals for the Second Circuit, which sits in New York City, ruled on 12/30/2015 that USCIS must provide notice of its intent to revoke an immigrant visa petition to those who actually will be affected by the revocation. This includes providing notice to the employee who moved to a new job or the new employer. The USCIS is required to implement this court decision. It is a very good news for foreign workers and other immigration beneficiaries. Revocation means( Cancelling an Approve i140 petition filed on ur behalf)

 

1)If you change ur employer , ur employer can send a cancellation notice to USCIS. and USCIS can revoker. idi current running trend.  

 ( Monna last month DEC ending lo i140 EAD Butter Pusina Cream Biscuit Rules okati came kada. a rule Implement aithe  i140 approve ayi 180 days datithe ur employer will lose the ability to cancel ur i140)

 

 

 

2). If uscis finds any false and mis representation of ur GC paper Work. USICS can revoke ur GC any time . This happens mostly when the employers dont follow all the paper work in the right way for ur GC process

 

Consulsion: revocation any reason , USCIS should inform u that they are revocating ur I140
