Guys,

 

Any one of you applied ITIN for your parents and showed them as dependents while tax filing? Last year my parents are here for 11 months after extending their visiting VISA.

 

I have seen different forums but see mixed answers about this.

dependent visa is different from visiting visa. Hope ur parents came on visitor visa. 

 

if so you cant apply.

unless its a dependent visa, u cannot file for ITIN and hence cannot include them as dependants in Tax filing

Its not about that. What is the process? Even i am curious.

u cannot claim them as dependents since they are on B1/B2..

 

forget about it..

Residency and Relationship

The technical term that the IRS uses to meet the relationship requirement for these tax and life situations is “Qualifying Relative”. This means that the person you’re caring for can be your parent, an in-law, or even a grandparent.

However, they must be related to you biologically, by adoption, or through marriage (which would technically be a biological relationship through your spouse).

And guess what?  The IRS has residency requirements as well. To meet the resident requirement, the person you are caring for must meet one of the following:

  • Be a legal US Citizen
  • Be a US National
  • Be a US Resident Alien
  • Be a Resident of Canada or Mexico

For foreign, non-US-citizen parents to achieve official US resident status, they must be a recipient of a Green Card issued by the US government or have lived in the US for 183 days during the past tax year.

nice info to know

 

@TS to apply for ITIN you must need original passport of your parents for verification have to send it to IRS they will return it after done with their processing by mail to you 6 -9 weeks

Its not that I want to file ITIN'S for my parents and save money in any way. Am more interested in knowing the process. If its 100% legal We can avail it. 

 

As you all see above responses, There's no pakka answer yet. Some one mentioned about turbotax which I have gone through as well. Any one living in USA for more than 183 days is considered as resident for TAX filing.

 

 

Looks like Only people who have actually applied ITINs for their parents (B1 Visa) can confirm about the Pro's & Con's of this process. Thanks every one.
