I have been asked to post this to encourage and motivate many members who may think that the status quo is okay. The bitter truth is - barring any legislative action and unless EAs work out the way we want it, EB India people whose PDs are at 2011 and beyond will have to wait for a VERY LONG TIME. There is no denying it and the proof is in the numbers. Spillovers to EB2I have decreased over the years for 3 reasons: 1. EB2ROW filings have risen over the years providing less spillover to EB2I. 2. Massive EB3I to EB2I porting continue to occur simply because EB3I is stuck in the 2004 thanks to the spillover law change. Moving forward, it seems this change has done us more harm than good as it has now clogged EB2 and EB3 movements. 3. Higher filings in EB1C resulting in less downward SO as Indians figure out the fastest way to get GC. I will not be surprised if EB1C soon gets a cut-off date. It is tough to judge their demand since they do not file PERM, only show up in pending inventory. Now coming to the numbers - There are many statistics to look at like Pending Inventory, DOS Immigrant Visa Stats etc. For ease of understanding, I am only showing the PERM filings. India filings have risen steadily since 2010. With the start of the H1B lottery system and the Indian IT staffing companies gaming the system, Indians have primarily taken over the H1B quota. Here are the India PERM filings over the years: 2008 - 23.7k 2009 - 16.7k 2010 - 22.3k 2011 - 30.0k 2012 - 36.7k 2013 - 36.0k 2014 - 40.0k 2015 - 43.7k Lets take 2011 since EB2I has not reached that date yet. 30k PERM filings will result in 63000 required GCs (considering 2.1 dependents per primary applicant). EB2I has been getting 16k-20k visas per year but the number has now decreased because of the 3 reasons above. Even if EB2I gets 15k visas per year, IT WILL TAKE MORE THAN 4 YEARS JUST TO CLEAR 2011 EB2I, and that is WITHOUT CONSIDERING PORTERS FROM EB3I. 2012 and beyond have higher India PERM filings, so the wait times will get subsequently worse per year.
