If anyone thought about this or found answers please help me to clear my question

H4EAD people can establish business. Once the business Up and running. The H1 person (spouse of H4 EAD who runs business) can transfer H1B to the same company . What are the implications.

If No, why? --> If the company has one board of director who is citizen? can we join back?

if yes, what are the implications

Ultimately, there are people in an office at USCIS that make these decisions. These people will reject applications if something smells fishy, will reject it if they think this is a shell corporation just so you can stay in the US, or if they don't understand that startups get started and hire employees in month 1 of existence. Keep in mind that this transfer has to happen quickly. Your previous employer has something like 30 days to report that you don't work there any more. And your new employer gets to keep you in the country as long as the visa transfer is in process, but if you get rejected you're out of the country. So the transfer needs to happen quickly...and often your company just got started, has no other employees, has no website or product in the marketplace yet, and has various other red flags as far as USCIS is concerned. The sequencing of all of these events in practice so that the USCIS does not get suspicious is difficult.

If an american citizen is legally a board member of the company ?  the company doesnt loose status. This is not a startup , it is of worth 5Millions.

It comes under same household, being a H1( nuv valid aithene h4 ead kuda valid avthadi) u cant be in ur own compny payroll. you (h1/h4) can own a business, house, property. USC as partner/co-founder will be an operations manager. technically, u came to US to work for 8hrs, no extra work out of ur scope(STEM).Thats the law.

Here a loophole is, u can float a compny, usc can be ur operational manager, ur h4 can be on ur company's pay-role. in simple, both payroles shud b on same company owned by one of you.
