hello987 Posted April 4, 2017 Report Posted April 4, 2017 04/04/2017: Trump Administration Asked Yesterday Appeals Court to Delay Decision of H-4 EAD Appeal Until 09/27/2017 Reasons: DHS is actively considering a rule-making process to revise the H-4 EAD rule. Should the Appeals Court accept this motion of the Justice Department, H-4 EADs will temporarily enjoy a room of breathe either until the DHS enact anther rule to revise the current H-4 EAD rule by rule-making process or the Appeals Court's decision after September 27, 2017. It thus appears that Trump Administration does not want H-4 EAD repealed either by the court nor Congress, not to mention repeal of the rule by the Administration. It just want to "revise" the current H-4 EAD rule by a rule-making process. Quote

DHS Considering Revisions to H-4 EAD Program 04 Apr 2017 The U.S. Department of Homeland Security (DHS) is “actively reconsider[ing] whether to revise …” the regulation that allows certain H-4 spouses to apply for employment authorization documents (EADs). This news comes via a DHS court filing, which asks the court to suspend any action on the pending lawsuit regarding the H-4 EAD program to allow the DHS additional time “to reconsider the [H-4 EAD rule] and whether issuance of a notice of proposed rulemaking relating to it is appropriate.” Although no details are provided with regard to what changes may be proposed, this certainly is cause for alarm for the thousands of H-4 spouses who rely on this program to be able to work in the United States. rajivn786 Posted April 4, 2017 Report Posted April 4, 2017 Immediate action will be on H1...Might be merit based...So obviously there won;t be need to do anything with H4 as automatically H1 restrictions will limit H4 EAD's... Quote
