If you h1b gets rejected in those 240 days...you will be in out of status from the day you filed h1n transfer... If your h1b is notapproved in 240 days...quit working and needs to go out of country...when its get approved...you can return to US. ...and needs stamping if old visa stamping is expired by that time... If your h1b getsapproved in 240 days...you are good and can continue without issues... Quote

phatposts Posted April 7, 2017 Report Posted April 7, 2017 If the new employer has filed a petition you can start working with the new employer only after the receipt came through! During the petition adjudication period you can work for the new employer. You will be out of status if your old employer terminates/withdraws your H1B AND the transfer did not go through (aka transfer is denied). Quote
