He can .. e pending h1 is generally called bridge h1 and he is not out of status and legally he can stay because of it . 

He can apply based on his parent h1 ..showing evidence he is maintaining status based on bridge h1 . 

Thr is no concept of transfer ..its just new h1 in cap exempt quota .. 

Worst case of anni docs unna ..i94 evvadu ..needs to go for consular processing .

But e bridge h1 dobbuthae he will accumulate 7 months of OOS and need to exit for US asap

I never said out of status ..Based on parent H1 chey vachu if it is valid..Parent H1 expire ayythe kastam..
