Got an FTE offer from Company B they are willing to do H1b Transfer but not committing anything about green card my question is 1) My H1b expires in 2019 based on my Employer A. once the H1b is transferred to Employer B. In 2019 can I apply for H1 Extension (over 6 years) Based on I140 approval from company A. 2) What if company B never applies for my Green card. Can I still continue working and making extensions based on the old I140 approved by employer A until my PD becomes Current ? 3) When PD becomes current then for I485 do I need to go back to my old employer ? please share your inputs thank you. sick and tired of contracting... Thinking of doing the same maintaing good relationship with Company A and taking the offer from Company B as it is very secured job and no lay off that's what the employees working there told me. But what if Company B doesn't apply green card at all ? I can still work and Have my H1 extensions right ? Quote

And trying to know how true it is ? Lastly, if your 1-140 application is approved and has been active for more than 180 days, then your old employer cannot just revoke it even if you quit the job under which you were awarded the I-140. They can only withdraw it. Which, of course, means that the I-140 will still be active and can be used for H4 EAD applications for your spouse and extending H1-B visas. Nonetheless, you will have to re-apply again in the future if you need it for any green-card-related purpose Quote

This is a snippet of what an attorney said in one of immigration forums. so just seeing if anyone here in i140 approved did H1 transfer and Got extensions based on old approved I140.  Even though this rule isn't a relief for all the problems being faced by high skilled legal immigration community it had some useful things: If your I-140 is approved for more than 180 days and then if you quit that job then your employer cannot revoke it but can only withdraw it. Meaning your I-140 is considered to be active and can be used for H1-B extensions or your spouse can apply for HE EAD. But you will still to need to reapply for it again for green card purpose.  Quote

But outside market for contracting is very bad. so not sure If i can find any good opportunities then in 2019. Quote
