Couple fight.. husband arrested... what next

Couple in CA got into serious fight.. husband hit wife...  Cops arrested hubby, filed case and released.

1 month before filed H1 extn and waiting for update (I140 approved).

Would he get H1 extn ??

if not----ask him to file divorce here in US eventually he needs to file divorce in India too as marriage is registered under "hindu act"

ekkada fast ga vastade and 99% she will not contest here as she will not have valid visa status to survive here after divorce if not working and can't expect much alimony
