What does this mean? While details are still forthcoming, it appears that all foreign nationals on work visas (e.g., H-1B, L-1, O-1, TN, etc.) who have applied on Form I-485 to adjust their status to lawful permanent residence will now be interviewed before their applications are approved and green cards issued. The new policy goes into effect on October 1 and will likely include all pending I-485 green card applications filed by employment-based visa holders.

 

 

 

While USCIS has always reserved the right to interview all green card applicants, for many years they have waived the interview requirement for most applicants other than marriage-based green card applicants and some special cases. This change in policy will add more than 100,000 interviews annually and will almost certainly result in more delays in I-485 processing and adjudication wait times.

 

 

 

Those employees on work visas and in the green card process who have not yet reached the I-485 stage will not be required to interview until they file the I-485 application.

NewsFlash! USCIS Expected to Increase Use of In-Person Interviews; Details Remain Unclear

According to two news reports, the U.S. Citizenship and Immigration Services (USCIS) is expected to greatly expand the use of in-person interviews for foreign nationals seeking certain immigration benefits while in the United States. The information, however, is fairly vague and confusing.

According to Politico, effective October 1, 2017, an interview would be required for any foreign national in an employment-based nonimmigrant category (e.g., H1B, L-1) who is applying for adjustment of status (form I-485). A report by NBC News, on the other hand, seems to imply that an interview would be required if a person in an employment-based nonimmigrant category is applying for a change in status to a different nonimmigrant category. The NBC News report further states that this “… new policy may be expanded to include other populations, such as students and green-card holders …”

The USCIS has yet to release an official statement on this matter. For the time being, it is unclear what the policy will be, and who, precisely, will be impacted.
