Mumbai: Twenty four years after 12 blasts rocked Mumbai on 12 March 1993 claiming 257 lives, a special TADA court in Mumbai on Thursday awarded death sentence to two persons and life imprisonment to two others, including Abu Salem, in the second phase of the trial in the case.

Following is the chronology of events in the case in which the main trial ended in 2007. The trial of seven accused in the case was separated, out of which six were held guilty on 16 June.

■ 12 March 1993: 12 explosions rock Mumbai resulting in 257 fatalities and injuries to 713 others.

■ 19 April 1993: Bollywood actor Sanjay Dutt (accused number 117) arrested.

■ 4 November 1993: Over 10,000 page-long primary charge sheet filed against 189 accused, including Dutt.

 

■ 19 November 1993: Case handed over to CBI.

■ 10 April 1995: 26 accused discharged by TADA court. Charges framed against the remaining accused. Supreme Court discharges two more accused – travel agent Abu Asim Azmi (Samajwadi Party leader) and Amjed Meher Baux.

■ 19 April 1995: First leg of trial commences.

■ 18 September 2002: Abu Salem detained in Lisbon, Portugal.

■ 20 March 2003: Accused Mustafa Dossa arrested by CBI at IGI Airport, New Delhi on his arrival from Dubai.

 

■ September 2003: Main trial ends. TADA court in Mumbai reserves judgement.

■ 9 January 2004: Charges framed against Dossa.

■ 11 November 2005: Salem extradited to India.

■ 9 December 2005: Charges framed against Salem.

■ 13 June 2006: Abu Salem’s trial separated.

■ 12 September 2006: TADA court judge P D Kode starts delivering the judgement, pronounces four members of the Memon family guilty, and acquits three. Later, 12 convicts were awarded death penalty while 20 were given life sentence. Other convicts were handed over different sentences.

■ February 2007: Main trial concludes. Second leg involving seven accused begins.

■ 16 March 2013 : Sanjay Dutt surrenders before court after SC upholds conviction.

■ 21 March 2013: Supreme Court upholds death sentence of convict Yakub Memon, brother of Tiger Memon, and commutes death sentence of 10 convicts to life term. Life imprisonment of 16 out of 18 convicts also upheld.

■ 13 August 2013: TADA court drops certain charges against Salem which violated the extradition treaty with Portugal.

■ 30 July 2015: Key conspirator and lone death row convict in the case, Yakub Memon hanged.

■ 7 December 2015: Final arguments of the second phase of the trial start.

■ 8 June 2016: Court rejects plea of accused Firoz Abdul Rashid in which he said he wants to become an approver.

■ March 2017: Trial concludes.

■ 16 June 2017: TADA court judge G.A. Sanap convicts six accused, including Dossa and Salem, and acquits one.

■ 28 June 2017: Dossa dies of cardiac arrest in Mumbai hospital.

■ 7 September 2017: Court awards death sentence to Tahir Merchant and Firoz Abdul Rashid Khan, life imprisonment to Abu Salem and Karimullah Khan and 10 years imprisonment to Riyaz Siddiqui.

Mumbai, Sept 7: A Special Terrorism And Disruptive Activities (Prevention) Act court in Mumbai on Thursday sentenced 1993 Bombay blasts convicts Abu Salem and Karimulla Khan to life imprisonment with a penalty of Rs 2 lakh each. The court also awarded death sentence to Tahir Merchant and Feroz Khan while, Riyaz Siddiqui has been sentenced to 10 years in jail.

Let’s look at the timeline and 13 key facts on the 1993 Mumbai serial blasts:

  1. The 1993 Mumbai serial blasts were the name given to the 13 bomb explosions that shook Mumbai on March 12, 1993.
  2. The most destructive bomb explosions in Indian history was first of its kind serial-bomb-blasts across the world.
  3. The first bomb went off at 1:30 PM in the basement of the 28-storey Bombay Stock Exchange building. Nearly 50 people were killed in the first explosion. In next two hours 10 minutes, from 1:30 PM to 3:40 PM, a total of 13 bombs exploded throughout Mumbai. The blasts were carried out by planting bombs in cars and scooters.
  4. In hotels, the bombs were left in suitcases.
  5. Till 3:40 PM, the bomb explosions were reported at Fisherman`s Colony in Mahim, Plaza Cinema, Zaveri Bazaar, Katha Bazaar, Hotel Sea Rock, Hotel Juhu Centaur, Air India Building, Sahar Airpot, Worli, and Passport office.
  6. The attacks were planned by Pakistan’s intelligence agency ISI and Dawood Ibrahim, India’s ‘most wanted’ absconder who also has his name on the United States’ ‘most wanted’ list. Dawood was assisted by Tiger Memon, who is believed to be hiding in Pakistan.
  7. While the bombs were financed by smugglers based in UAE — Hajji Ahmed, Hajji Umar, Taufiq Jaliawala, Aslam Bhatti and Dawood Jatt — another accused Abu Salem was involved in the transportation of the weapons from Gujarat to Mumbai for the purpose.
  8. As per the reports, Abu Salem also handed over AK 56 rifles, 250 bullets and some hand grenades to actor Sanjay Dutt in January 1993. The reports also have it that two days later, Salem and two others went to Dutt’s house to get back the weapons and hand grenades.
  9. According to reports, most of the accused came from a poor background and were prompted to carry out the attacks as a revenge for Babri mosque demolition.
  10. Several terrorists received arms and training in Pakistan and were recruited from Dubai.
  11. As per the reports, the original plan was to attack Mumbai in April 1993 during the Shiv Jayanti celebrations. The attacks were advanced when Gul Noor Mohammad Sheikh aka Gullu, who was one of the men handpicked by Tiger Memon for training, was detained on March 9, 1993.
  12. During the investigation, Gullu revealed about his training in Pakistan and also about the conspiracy to attack Mumbai at several locations including Shiv Sena Bhavan, Bombay Stock Exchange etc. However, his claims were rubbished by the police.
  13. Sharad Pawar, who was the then Chief Minister of Maharashtra in 1993, admitted that he made false statement to prevent riots in Mumbai.

1993 Mumbai blasts: Forget hanging, Abu Salem may not even spend his entire life in jail

 

Despite being held guilty of conspiracy under the stringent TADA, Abu Salem managed to escape the noose while co-conspirators Tahir Merchant and Feroze Khan were given death penalty.

Gangster Abu Salem was today sentenced to life imprisonment by a special TADA court in the 1993 Mumbai blasts case.

The quantum of punishment for Abu Salem was announced 24 years after a series of 13 blasts rocked the country's financial capital, Mumbai, killing 257 people and injuring 700 others.

In June, the special TADA court had convicted Abu Salem, Mustafa Dossa, Mohammed Tahir Merchant, Karimullah Khan, Riyaz Siddiqui and Feroze Abdul Rashid Khan in the 1993 Mumbai serial blasts.

 

Abu Salem, one of the main conspirators in the 1993 blasts, was guilty of procuring and supplying arms and ammunition, including AK-47 assault rifles, bullets and hand grenades, from Gujarat to Mumbai in 1993.

Despite being held guilty of conspiracy under the stringent TADA, Abu Salem managed to escape the noose while co-conspirators Tahir Merchant and Feroze Khan were given death penalty. Why?

The answer lies in the extradition treaty signed between India and Portugal, under which the extradited person cannot be sentenced to death, nor can he/she be sentenced to life imprisonment beyond 25 years.

This extradition treaty was signed in January 2007, more than a year after Abu Salem was extradited from Portugal on November 11, 2005. The treaty was signed between then Prime Minister Manmohan Singh and Portugese President Anibal Cavaco Silva.

Further, under Section 34C of The Extradition Act, 1962, a fugitive criminal, who is surrendered or returned by a foreign state on the request of the Central government and the laws of the country do not provide for a death penalty for such an offence, "shall be liable for punishment of imprisonment for life only for that offence".

Portugal, from where Abu Salem was extradited, has abolished death penalty in 1867. The clause in the Extradition Act, therefore, meant that Salem could not be sentenced to death as per law.  

Senior CBI counsel Deepak Salvi, while arguing for maximum sentence for the convicts at an earlier hearing in June, had told reporters outside the court that while Abu Salem's acts were no less than other convicts and he deserved death penalty, but Salvi had not yet decided if he would be asking for it.

"The fact that an extradition treaty has been signed between Portugal, from where Salem was arrested and sent to India, and wherein our country has explicitly written that India cannot give death sentence to Salem, I have not been able to decide if I should ask for death sentence for him or not," the CBI counsel had said.

Explaining the sentencing of convicts in the 1993 Mumbai blasts case, senior public prosecutor Ujjwal Nikam today said that the prosecution could not have asked for the death penalty for Abu Salem due to India's extradition agreement with Portugal.

Following the pronouncement of punishment to Salem and others, CBI counsel Deepal Salvi said that although Abu Salem has been sentenced to life, the government can exercise its powers to commute the sentence to 25 years in jail.

Going by the extradition treaty clause, it is likely that Abu Salem's imprisonment could last only 25 years.

Portugal nunchi extradict cheste akkadi rule prakaram follow avvali else they won't allow extradiction & their death penalty is abolished long back and a sentenced can be given punishment of max 25 years.
