09/12/2017: Approaching Trump Administration Action on H-4 EAD Rule

• H-4 EAD has been sued and the federal court has postponed the decision pending the decision of Trump Administration on the H-4 EAD program within less than a month. The Trump Administration had an option either to repeal or amend the H-4 EAD program by a rule-making process. Pending the decision, the Attorney General Jeff Sessions will have to either refuse to defend the H-4 EAD rule and let the federal court to decide on the merits of the lawsuit or let the plaintiff drop the lawsuit or the court dismiss the lawsuit based on the agreement of the Attorney General with the plaintiff to change H-4 EAD program or repeal by the Trump Administration. Thus far, there is no rule-making process in place either to amend or repeal the H-4 EAD rule. H-4 EAD community should watch carefully for the next one month with development of this lawsuit and potential action of the Trump Administration to initiate any rule-making process on H-4 EAD program.
