Can President Donald Trump repeal the H4 EAD visa through an Executive Order or can he not ?

The short answer is that H4 EAD can be easily replaced by an Executive Order followed by a quick Rule Making process. The Rule-making process is also called “Notice and Comment Rule-making”. However, the administration may chose not to repeal the H4 through an Executive Order. They may play the invisible hand in the Appeals Courts case between Save Jobs USA and DHS (Department of Homeland Security). DHS may weakly defend the case or may reach an out of court settlement with the plaintiff essentially killing the H4-EAD program. Likewise, it is quite possible that they may not make any changes to the H4-EAD program leaving it as it is. They may instead focus on tightening the H1B program as well further delaying the already lengthy Green Card process. What may happen is speculation as nobody knows for sure how things will play out. There has been some confusion that the Rule Making for repealing H4 can take anywhere from 12-24 months. This assertion is completely wrong as I will explain below. In all the repeal case studies, never has a repealed Final Rule taken more than 90 days on the average.
