Growing H-1B Visa Restrictions and Apparent Increase of U.S. Businesses Seeking Off-Shore Services in Foreign Countries to Meet Their Needs

  • Lately, the Trump Administration has been tightening H-1B petitions as part of its implementation of the President Trump's Executive Order of Buy American and Hire Americans, creating vacuum for U.S. business to fill the need of high-tech workers. In order to fill the vacuum, some reports indicate that U.S. businesses are seeking off-shore services, taking the potential jobs to foreign countries. Unlike the past experiences where some businesses took out businesses off-shore for profit purposes, current trend of taking the jobs out to foreign countries apparently is created by Trump Administration's growing restrictive policy against hiring of high-tech foreign workers to work in the United States. From the perspectives of the motive for the businesses hiring foreign workers, there appear to be miles of difference. In a way, current trend is motivated and pushed by the need for the businesses to survive as opposed to past off-shore hiring practices of some businesses that were primarily motivated by their profits.
  • One other impact probably the current Trump Administration could have neglected appears to be a huge difference in impact on the United States between off-shoring of the hi-tech jobs in foreign countries and importing of hi-tech foreign workers into the country. Assuming that a U.S. business hires 10 high tech workers overseas to work off-shore, such workers do not have to pay income taxes in the United States. Additionally, their income and spending will not contribute to the U.S. economy in that their income in foreign countries are spent in foreign countries contributing to the foreign countries. Assuming that the country's economy needs the services of 10 hi-tech foreign workers, no matter why, it is thus obvious that importing the needed 10 foreign workers would serve the country better than hiring 10 foreign workers to work off-shore.
  • It is obvious that when it comes to need for services of hi-tech foreign workers, there are sufficient studies and statistics that indicate that the country needs such hi-tech foreign workers. Accordingly, from the perspectives of national interest, importing of the needed hi-tech foreign workers would be a much better national policy over the hiring foreign workers to work in foreign countries. The current policy of the Trump Administration to restrict hiring of H-1B hi-tech foreign workers to work in the United States may be a mis-guided decision which the Trump Administration should abandon as soon as possible.
