In California, red light camera tickets, like all other traffic tickets, are criminal cases and can only be charged against the actual driver. If the police cannot figure out who the driver is, he/she cannot be prosecuted. The police can find the registered owner, but the owner has no legal obligation to reveal who the driver was. And the registered owner cannot be found guilty in a trial for a violation committed by someone else, unless the driver's picture looks like the owner beyond a reasonable doubt. The red light camera companies and police departments try various ways to figure out who the driver is. They start with the registered owner, and if the DMV picture of the owner obviously does not match the driver, they try to look at other people who have driver's licenses at the same address as the owner; this often catches family members. Or perhaps they can look at people who have previously gotten tickets driving this car. Quote
