You Can , While your going back , you need to inform your attorney/Employer so that they will change 140 to Consular process.

 

when your date is current you can still apply 485 and you need do your finger printing and other formalities in US consulate India.

h1b and i 140 are two different. India poye EAD vachaka ravochu..

1. Ur I 140 should remain active 

2.When ur trying to come Back, if u still need to come in H1B,

     a. then ur old H1B should be in active for atleast 1 day in last 6 years, so that u come under non cap

   b. else u come under cap

True--google mein consulate processing search karo..U can come back...U dont need H1 when ur dates becom current
