if I-140 approve ayyiendhi  and 6 months avvaledhu ..................can my new employer transfer the I-140  if old employer doesn't revoke it??

or should I  wait for 6 months and transfer to new employer?

I-140 is employer sponsorship. If he revokes, you will lose your PD. Don't recommend to do it.

Revoke means he is revoking his sponsorship, meaning, if dates become current you cannot file I-485 immediately. You still have to file from Labor but you can save your PD.

if you are extending h1b based on i140, you need to do when it is active or when you stayed with old employer more than 6 months.

nope.. once i140 approved date remains.. if you wait for 6 months even if the employer withdraws it doesn't matter you can use it for future extensions

Gurus,

mixed vinna so asking

1) Is the 60 day grace period after h1-b employee layoff is applicable to all or only to i-140 approved candidates ? any other restrictions here ?

2) Can Employer-A apply for H1-b extension or H1-B transfer to Employer-A using approved I-140 applied by Employer-B after 6 years of H1-b?  (staying 6 months with Employer-B after i-140 approval).

1. 60 day grace period for every h1b holder irrespective of I-140 and it is given for each H1b validity period.

2. lakshanamga employer A cheskovachu renewal or transfer after 6 months of I-140 renewal. per the latest rule okkasari I-140 approve aiyyi 6 months complete aite that will be permanently used to renew H1b and retain the priority date. only thing is nee date current aite, malli labor, I-140 apply chesi I-485 ki vellali with old priority date.
