Dear All,

I would like to take a few moments to remind you of the upcoming H1-B CAP season, which begins on April 2nd, 2018.

Due to the recent trend with the H-1B RFEs, it is very important that we review the detailed Job description and the beneficiary’s educational documents in detail before choosing the SOC code for filing the LCA. To ensure that we have sufficient time to review and file all the CAP cases in a timely manner, we request that you submit all the cases to us no later than February 24th, 2017.

Also, below are some of my recommendations to achieve higher success rate on the H-1Bs:

1.     Avoid choosing level 1 wages.

2.     Avoid the following SOC codes:

a.     15-1121- Computer Systems Analysts (only 47 % of these positions require a Bachelor’s degree)
b.     15-1131-Computer Programmers (only 78 % of these positions require a Bachelor’s degree)
c.     15-1134.00 - Web Developers (only 46 % of these positions require a Bachelor’s degree)
d.     15-1141.00 - Database Administrators (only 77 % of these positions require a Bachelor’s degree)
e.     15-1142.00 - Network and Computer Systems Administrators (only 52 % of these positions require a Bachelor’s degree)
f.      15-1199.01 - Software Quality Assurance Engineers and Testers (only 52 % of these positions require a Bachelor’s degree)
g.     15-1199.02 - Computer Systems Engineers/Architects (only 61 % of these positions require a Bachelor’s degree)

3.     Be very careful in stating the position requirements. A position that requires a bachelor’s degree in unrelated fields (e.g Computers and Business Administration) may not qualify as a specialty occupation.

4.     Please refer to the Occupational Outlook Handbook before deciding on the degree field required for the position.

Please don’t hesitate to contact me if you have any questions or concerns. Thank you.
