i am holding h1b, naa i94 expire ayi 360 days avuthundi, still my h1b extension lo vundi. Do i eligible to stay in usa present, untill i get my extension result.

+1 you can only work till 240 days. After that you can stay but cannot work.

You said your i94 expired 1 year back. Is your extension also pending from 1 year ?

Talk to a lawyer immediately. You will be placed in 3 yr reentry ban automatically when u leave the country. Dont sit and be happy reading answrrs here. Expired i94 is illegal status which is different from out of status.

More than 180 days unte expired i94 to ..u will get 3 yr ban. I think for cases with more than 1 yr..its 10 yrs if i am not wrong. This ban is placed by CBP when u fly out of the country based on ur duration of stay illegally. Airlines has to submit this to cbp on every outbpund flight. U will know abt ur ban at pie when u try to enter next time. They dont check ur case status with uscis.

You an live in US but cannot work .one of my friend also faced the same situation. He stopped working after 240 days . Try to convert your case to premium.

You were supposed to work only 8 months. You already worked out of status for 4 months. Surprised your attorney didn't warned you. Contact your attorney immediately

see this it says u cannot work after 240 days but can stay but out of status but not illegal.. talk to ur attorney and please share us what happened

You said the other way round i94 expire iythe u will be out of status not illegal
