Man arrested for alleged Vehicular homicide

A local man has been arrested and charged with homicide by vehicle following a wreck on Peachtree Parkway that left one dead last weekend.

Vivekanandan Kandasamy, 39, of Cumming surrendered himself to the Forsyth County Sheriff’s Office Monday morning and was charged with homicide by vehicle second degree and failure to yield right of way, according to Cpl. Doug Rainwater of the Forsyth County Sheriff’s Office.

Rainwater said that on April 14, Gregory Smith, a 64-year-old from Duluth, was pronounced dead at North Fulton Hospital after his motorcycle collided with a van at the intersection of Peachtree Parkway and Sharon Road. He said that Kandasamy, the driver of the van, allegedly failed to yield the right of way when turning onto Sharon Road and was struck by Smith, who was driving northbound on Peachtree Parkway.

“Through our investigation, Deputy First Class Andy Ives found that [Kandasamy] was at fault,” Rainwater said.

Kandasamy and a juvenile passenger of the van were unharmed in the incident.

Rainwater said that Kandasamy has been booked into the Forsyth County Jail and has no bond at the present time.

First degree homicide by vehicle is a felony offense, and a conviction is punishable from 3 to 15 years in a state prison, or between 5 and 20 years for a habitual violator.

Second degree homicide by vehicle is a misdemeanor offense, and may result in up to 1 year in jail, and/or a fine of $1,000. Second degree homicide basically covers all other types of homicides by vehicle which isn't covered under first degree homicides.

law is pakka here na friend okadu state highway lo madya nadustunna candidate ni guddadu. Teh other guy was injured but no charges filed since the other guy is at fault
