Denying jobs to spouses of H-1B visa holders could hurt thousands of families in the US

Krithika Rajan, an Indian mechanical engineer-turned-software tester at PwC in New Jersey, is worried about losing her job when the US rescinds the law that allows her to work.

She’s employed under the H-4 EAD (Employment Authorisation Document) visa issued to spouses with H-1B visas and in the queue for a Green Card. The Trump administration wants to scrap the Obama-era relaxation in the next few months.

“We need two incomes to support our family. We have a house mortgage and two car loans to pay back and are expecting our second child. This new rule could throw much of our financial planning out of whack,” said Rajan. “Most importantly, I'm extremely passionate about my work, so the thought of not being able to do my job unless my husband lands a Green Card is very concerning.”

UPHEAVAL FOR MANY FAMILIES
The move, in line with the anti-immigration stance of the Trump administration, will result in upheaval for many of those families. Poorvi Chothani, managing partner at immigration law firm LawQuest, said the Trump administration is trying to change every regulation it can without having to go to Congress.

“This will not have a direct impact on the IT companies but it will have a very negative impact on the H-1B workers,” she said, adding that that those affected are H-1B visa holders who have an approved Green Card application. “So, if they are forced to relocate to India since the wife cannot work anymore, they are basically chucking a Green Card and a life in the US.”

She added that couples in the US need a double income to have a reasonably good life and those who have taken mortgages after spouses were allowed to work will have a hard time making ends meet. “It’s a negative measure and one more nail in the coffin which will make businesses rethink their hiring strategy,” Chothani said.

Sushma and Venkat are software engineers. In 2016, Sushma moved to the US East Coast on an H-1B visa. Venkat’s application did not make it through the lottery and he moved to the US on an H4 visa. He got his EAD a month ago and the couple were relieved there would be two paychecks coming in. Their joy was short lived. Employers and interviewers have been seeking clarity on his employment visa status.

“We are back to square one and Venkat has to sit at home adding to our insecurity and confusion over his future and career. We recently had a baby and our expenses have gone up, adding to our financial insecurity,” said Sushma. She was also worried about returning to India given the job market back home.

na doubt enti ante ippudu H4 tesesi H1 kastam chesi OPT lo 3rd party jobs ban cheste...e personal loans/credit cards/car loans/housing loans teesukunnavallu default cheste local businesses ki loss rada? i mean enta impact untadi auto n real estate market meeda where our number is more like Dallas, Cali, NJ etc..

Immigrants raavali ante mundu mundu vallu they need to allow people to work. Lekapothe kashtam. And good luck filling all the positions.
