I was not denied but rfe padite I filed new petition with both expired (amendment).  But previous extension petition had I94 till May next year

Earlier my friends re filed even after i94 expiry and got approvals.

may be ippudu aa rule ledu ani chepthunnadu anukunta new doc lo.

so better to apply in premium and get the result before I-94 expiry.

and 60 day grace is if you do not have I-94 expiry

but your  rfe petition was pending with USCIS though .. until you get decision ..it is allowed to file new petitions  by new/same employer
