Not having 50% employees is different from discrimination during hiring. They have to prove that a certain position even though advertised was not offered to Americans. Mostly mesthrilu don’t put any ads for jobs. They are just body shops and staffing firms. The only way they can find is by having someone apply for jobs and not get picked or called. The LCA must be certified by the Department of Labor (DOL) before the H1B petition is submitted to USCIS. The employer must also document compliance with the LCA requirements in a public access file.
