Case knchm different

I 94 expired in July extension applied  in regular in June no update from uscis on case number waited till July as per suggestion applied another petition in July end this time applied in premium but so far no update on the case number . So legally is he out of status or can we  use the info submitted in June that its not mistake from our end . What are his options ..Calif center
