If H1-B transfer's application with company B gets approved and even if you don't start working for them, you have to use that I-797 for your transfer with Company C. If you want to go with Company C, try to ask Company B to withdraw transfer application. LTT for better replies. In that case C will ask for company B's pay stubs right.. I am still on A's payroll.. not joined B.. Quote

I am now with company A with a valid H1B petition till 2020. I started looking for a better opportunity and attended interviews and got an offer from a Company B and they initiated H1B transfer process in Premium processing. Now I got an offer from a very large firm they are preparing for H1B-transfer process, as its a big firm its taking time to initiate H1-B transfer. Q1: Should I ask company B to withdraw their petition as there is very little time left in premium processing 15 days window? Q2: I haven't informed company C about Company B transfer petition. Both Company B and C are applying based on my current employer (Company A). If Company B petition gets approved and I haven't started working for them, can company C still go ahead and file for transfer based on Company A? Q3: Is it okay if I never join company B and join the company C so they can revoke the petition, I know it's not ethical but I couldn't do anything about it? Q1: Not required to withdraw. It wont effect other H1B's if in process or approved. Q2. No need to inform. If B gets approved or in processing it is good for you. Appove ayithe work start cheyalani em ledu. U can still go for C Q3. yeah, but please inform them once you get your C approval as a courtesy that you are not going to join. Most employment agreements are at-will, so no big issues. H1B transfer is always a new petition. Just quota loki ravu anthe. Quote

You do not need to be worried if B gets approved before C starts. Figure a way to stall the joining date. If A revokes and B is rejected and C has not started the process then your are in trouble.
