CBI Director Alok Verma's Interest in Rafale May Have Tipped Scales Against Him

Verma, ousted in the early hours of Wednesday morning, has now moved the Supreme Court.

New Delhi: The government’s 2 am decision to oust director Alok Verma as the director of the Central Bureau of Investigation came hot on the heels of not just his request for sanction to arrest an official considered close to Prime Minister Narendra Modi but also fears about his interest in the controversial Rafale deal.

Last week, the CBI filed an FIR charging Rakesh Asthana – special director in the CBI and a Gujarat cadre police officer propelled to prominence in the agency by the PMO – with bribery and corruption. Since official sanction from the government is needed to arrest any officer above the rank of joint secretary, Verma had placed a request but permission was not granted.

 

The Wire has also learned that Verma – who was selected by a high-powered collegium including the Chief of Justice of India for a protected tenure “not less than two years” that ends in January 2019  – may have been readying himself to initiate a preliminary enquiry (PE) in to the Modi government’s controversial decision to purchase 36 Rafale aircraft from Dassault Aviation, with a major part of the offset contracts going to an Anil Ambani-led company.

The decision to purchase 36 aircraft in a flyaway condition – in lieu of the originally cleared proposal of buying 18 flyaway fighter jets and manufacturing 108 in India – was taken personally by Modi and announced by him in Paris on April 10, 2015 allegedly without any of the necessary statutory clearances and is now the subject of a criminal complaint to the CBI filed by former BJP ministers Yashwant Sinha and Arun Shourie and lawyer Prashant Bhushan, and also a PIL in the Supreme Court.

The trio of Sinha, Shourie and Bhushan had submitted a voluminous complaint to the CBI. Verma not only received the complaint but sought a confirmation from the defence ministry about the authenticity of the official documents they had referred to.

Earlier this year, in fact, Aam Aadmi Party Rajya Sabha MP from Delhi Sanjay Singh had written to the CBI and CVC asking that the Rafale matter be investigated, and that correspondence is also part of the official record.

While the Supreme Court has asked the government to inform it of the procedures it has followed in the entire aircraft deal – a significant move since the Prevention of Corruption Act criminalises certain official decisions taken in disregard to procedure – Verma too had begun the process of looking at some of the Rafale deal documents and reportedly wanted the defence ministry to authenticate them, authoritative sources have told The Wire.

Verma’s interest in the Rafale deal was likely seen by the prime minister and his closest aide in government,  national security advisor Ajit Doval, as a dangerous shot across the bow and seems to have been the key trigger for the CBI director’s removal.

The net effect of the prime minister’s action is that the upper echelons of the CBI have been virtually dismantled as all teams have been dissolved and the CBI building sealed with unknown intelligence officials carrying out raids.

Nageshwar Rao, who has replaced Verma as acting director, is the first IG-level official ever to be chief of the CBI. Verma wanted action against him too but the Modi-appointed Chief Vigilance Commissioner, K.V. Chowdhary resisted. Rao’s first decisions have been to move the officials who were investigating Asthana out of headquarters.

Notionally, the Modi government is claiming to have acted on the advice of the CVC but the move is bound to be challenged  at the Supreme Court. Noted lawyer and activist Prashant Bhushan confirmed to The Wire that he is moving the apex court, whose orders, he says, the Modi government has flagrantly violated.

Already, opposition politicians have accused Modi of ousting Verma to ensure the Rafale deal is not taken up for investigation.

 

While the Modi government’s unofficial spin to the media is that the Centre has acted against both Verma and Asthana, officials familiar with the case insist there is no equivalence between the two. Verma, they say, is the CBI director with a collegium protected tenure who acted with the full backing of the law against his junior for alleged bribery and extortion.

This was never a turf war as is being made out in the media but an outgrowth of the Modi government’s attempts to politicise the functioning of the CBI. As director, Verma insisted on ensuring that extra constitutional authorities did not carry out a political vendetta against rival politicians. Special director Asthana, on the other hand, appeared eager to play out political agendas. When Verma as director resisted, Asthana sought to make this an issue in a complaint to the CVC.

Top CBI officials say Asthana has also acted in ways that have weakened the case against Vijay Mallya, as reported in The Wire.

Sources say Modi, BJP president Amit Shah and Doval were in a huddle from early evening. The result was what is being termed as a ‘coup against the CBI. Top officials say this is the latest example of the “undeclared emergency” – an action unsupported by an law.

SC to hear Alok Verma’s plea challenging move to send him on leave

The Supreme Court on Wednesday agreed to hear on October 26 the plea by CBI Director Alok Kumar Verma challenging the Centre's decision to send him on leave.

Advocate Gopal Shankarnarayanan mentioned Verma's petition before a Bench headed by Chief Justice Ranjan Gogoi saying the investigating officers of sensitive cases were being changed.

The Bench agreed to take up the matter on Friday.

Shankarnarayanan told a Bench headed by Chief Justice Gogoi that the government in a decision taken in the wee hours of Wednesday asked Director Alok Verma and Special Director Rakesh Asthana, who have been at loggerheads, to proceed on leave. It has jeopardised the probe into sensitive cases, he said.

The Bench agreed to take up on Friday the petition arising out of the CBI top officials' infighting and the government's decision to send the two on leave.

The government asked Joint Director M Nageswar Rao to take charge as acting CBI chief.

CBI Chief Alok Verma Sacked: Read Full Notification Of Government’s Unprecedented Move Here 

Amid row between the number 1 and number 2 at CBI, the Centre has issued notification to appoint Joint Director M Nageshwar Rao as interim CBI director in an unprecedented move. Sources have now told Republic TV that 10th and 11th floor of the CBI Headquarters which have been sealed which host the offices of Director CBI, Special Director CBI and all Joint Directors CBI. Sealing has been done as a standard measure. The sources have also said that Nageshwar Rao took charge as CBI Interim Director around 2 am this morning.

The Department of Personnel and Training of the Ministry of Personnel, Public Grievances and Pensions in its notification has said, "The Appointments Committee of the Cabinet has approved that during the period of the subsistence of the aforesaid interim measure, Shri M Nageshwar Rao, IPS, presently working as Joint Director, CBI shall look after duties and functions of Director CBI and shall take over the duties and functions with immediate effect."

Earlier on Tuesday, CBI's DSP Devender Kumar, arrested in connection with bribery allegations involving its Special Director Rakesh Asthana, was on Tuesday sent to seven days of the agency's custody for interrogation by a designated court as the CBI added fresh charges of extortion and forgery to the FIR.

Terming the offence as "grave", special CBI Judge Santosh Snehi Mann said "considering the gravity of the offence and seriousness of allegations about the involvement of public servants including accused, I am of the opinion the police custody of accused Devender Kumar is necessary for proper investigation.

"Accused is remanded to police custody for seven days," the judge said in the order.

The court also turned down a plea taken by the counsel of the accused that the agency had not taken requisite prior permission under section 17-A of the prevention of corruption act from the competent authority.

During the proceedings, the agency also informed the court that it has added some fresh sections -- 384 (punishment for extortion), 388 (extortion by threat of accusation of an offence punishable with death or imprisonment for life), 389 (putting person in fear of accusation of offence, in order to commit extortion), 468 (forgery for purpose of cheating) and 471 (using as genuine a forged document or electronic record) -- of the IPC in its FIR.

Besides Asthana and Kumar, two middlemen Manoj Prasad and Somesh Prasad have also been named as accused in the case.

During the hearing before the trial court, the CBI said that Kumar's custodial interrogation was necessary to unearth the criminal conspiracy hatched by the accused persons in commission of the offence and their specific roles.

It said that during the searches conducted by the CBI at the office chamber and residential premises of the accused, a number of documents have been seized.

The agency alleged that the accused tried to create false evidence during investigation of the other case and has refused to cooperate in the investigation.

M Nageshwar Rao has been appointed as the interim director of the Central Bureau of Investigation (CBI) after the premier agency’s special director Rakesh Asthana and its chief Alok Verma were divested of all duties late on Tuesday night, as a fallout of a spat between the two.

Prime Minister Narendra Modi-led Appointments Committee in an order on Tuesday night gave the charge to Rao with immediate effect, a government order said. Rao, a 1986 batch Indian Police Service (IPS) officer of the Odisha cadre, was working as the joint director in the investigating agency.

The order implies that the government has sidelined all the three additional directors, number three in the agency hierarchy, including AK Sharma whose name had figured in the complaint by Asthana.

In his first order as acting chief, Rao removed the entire team probing the bribery case against Asthana, including Ajay Bassi, the investigation officer (IO), and deputy inspector general Manish Sinha. The case was under the anti-corruption headquarters zone, which was under the powerful joint director Sharma.

The decision to give CBI’s charge to Rao comes after Asthana moved the Delhi high court on Tuesday seeking the quashing of the First Information Report (FIR) filed against him by the investigating agency. The court later ordered that no action would be taken against Asthana until next hearing, which is scheduled for October 29.

Union minister Arun Jaitley said the government’s decision to remove CBI director Alok Verma and special director Rakesh Asthana was based on the CVC’s recommendations.

The government said on Wednesday Alok Verma, who was removed as the Central Bureau of Investigation’s (CBI) director, did not cooperate with the Chief Vigilance Commission probing the allegations of corruption against him despite repeated assurances and reminders to furnish records and files.

“… The CVC has observed that Director, CBI has not been cooperating in making available records/files sought by the Commission relating to serious allegations,” it said in a statement.

“The CVC has also observed that the Director, CBI has been non-cooperative with the Commission, non-compliant with the requirements/directions of the Commission and has created wilful obstructions in the functioning of the Commission which is a Constitutional body,” it added.

It said Verma and his deputy Rakesh Asthana were removed in the “interest of equality, fair play and principles of natural justice” amid an “extra-ordinary and unprecedented situation” even as the opposition mounted an attack over its late-night decision. Asthana, the second senior-most officer in the federal agency has been accused of taking bribes.

The government said the allegations of corruption by senior CBI officer against each other “vitiated the official eco-system of the organization.”

“The environment of faction feud has reached its peak in the CBI leading to a potential loss of credibility and reputation of the Premier Investigating Agency of the Government It also vitiated the working environment of the organization which has deep and visible impact on the overall governance.”

Union finance minister Arun Jaitley defended the government in a press conference, saying Verma and Asthana were removed from their posts to maintain the agency’s institutional integrity and fairness.

“Officers under cloud must stand out as interim measure. This is in accordance with the highest standards of fairness,” Jaitley said, pointing to the allegations and counter-allegations that Verma and Asthana had levelled at each other.

The minister also asked if the government’s critics wanted the two officers facing corruption charges to handle their probes or supervise them.

Verma has challenged the government order removing him from the CBI director’s post after he filed a corruption case against Asthana. He was appointed in January 2017. The court has listed the matter for hearing on Friday.

Asthana had secured protection from arrest from the high court, which ordered a ‘status quo’ until the next hearing on October 29.

Their removal has triggered a political row, with opposition leaders criticising the move and Congress wondering if Verma was “sacked” for his keenness to probe the “layers of corruption” in the Rafale scam and sought an answer from Prime Minister Narendra Modi.

The Congress also claimed that the Central Vigilance Commission, which had recommended stripping Verma and Asthana of their charge, had exceeded its mandate.

“The CVC has no powers to appoint or disappoint CBI director... it has no power to interfere in the law,” senior Congress leader Abhishek Singhvi said in Delhi.

Congress president Rahul Gandhi, who is campaigning in Rajasthan’s Jhalawar, also said in a tweet that Verma was forced to go on leave because he was collecting documents relating to the Rafale deal.

“The Prime Minister’s message is clear; whoever comes close to the Rafale case will be removed, erased. The country and constitution are in danger,” he tweeted.

Alok Verma has challenged his removal in the Supreme Court which will hear his case on Friday

Alok Verma, the CBI chief who has been exiled into leave, has told the Supreme Court that the autonomy of the country's premier investigating agency is being compromised and by malintent that includes when "certain investigations into high functionaries do not take the direction that may be desirable to the government".

Mr Verma was replaced as the top boss of the CBI in a 1 am coup that saw the CBI headquarters in the capital being cordoned off by the police before the man chosen as the new CBI head, M Nageswar Rao, drove in and took charge.

Like Mr Verma, the CBI's No. 2 officer, Rakesh Asthana, has also been sent on leave; this was necessitated to "maintain the CBI's integrity", claimed Finance Minister Arun Jaitley today. The minister cited the public feud between Mr Asthana and Mr Verma - both men have accused each other of accepting bribes worth crores by men being investigated by the CBI. Earlier this week, the CBI named Mr Asthana as an accused in an FIR; yesterday, he asked the Delhi High Court to cancel that FIR or police case; it did not do that, but it banned the CBI from arresting him till Monday, when it will next hear the case.

Mr Verma has challenged his removal in the Supreme Court which will hear his case on Friday. His petition says that Mr Asthana "concocted evidence" against him to accuse him of corruption and that he was inevitably at odds with the opinion of majority officers in sensitive cases.

"Not all influence that is exerted by the political government would be found explicitly or in writing. More often than not it is tacit and requires considerable courage to withstand," says the petition. Mr Verma also promises to give details of "many cases that have led to the present circumstances". 

The opposition has alleged that Mr Verma has been sent on leave - effectively sacked - because he was weighing an inquiry into India's purchase in 2015 of 36 Rafale fighter jets from France; earlier this month, Mr Verma personally met with Arun Shourie, Prashant Bhushan and Yashwant Sinha, all critics of the Modi government, when they filed a complaint about corruption in the Rafale deal; his in-person greeting of them to accept their complaint had angered the government, NDTV had reported

Mr Asthana is known for his proximity to BJP chief Amit Shah and Mr Verma's removal today is seen as a major victory for him. Mr Asthana was made No. 2 in the CBI though he was tainted by allegations of accepting favours and bribes and was named in six cases being investigated by the CBI. While a senior police officer in Gujarat, he handled the case involving the Godhra train burning, which led to three-day communal violence across Gujarat in 2002, and the Sohrabuddin Sheikh fake encounter case, in which Amit Shah was discharged.

In the latest development in the ongoing spat at the Central Bureau of Investigation, Director Alok Verma and Special Director Rakesh Asthana have been “divested of all powers” and Joint Director M. Nageshwara Rao has been put in-charge with immediate effect.

Who is the interim Director?

Mannem Nageshwara Rao, the Joint Director of CBI, is a 1986 batch Indian Police Service officer from the Odisha cadre. Hailing from Telangana's Warangal district, Mr. Rao was earlier posted in South Zone, Chennai. On May 3, he took charge as the Additional Director in the CBI headquarters and was looking after the Chandigarh unit. Mr. Rao will “look after duties and functions of Director CBI” and shall take over the role with immediate effect, said the government order by the Appointments Committee of the Cabinet. The CBI Director usually has a fixed tenure of two years.

What led to this?

Earlier reports had suggested that Mr. Asthana could be asked to go on leavefollowing charges of corruption and falsification of records. The CBI had named its second-in-command as an accused in a bribery case, along with Deputy Superintendent of Police Devender Kumar and two private persons. The agency said that more than ₹3 crore in bribes were paid by the complainant for getting relief in a case against meat exporter Moin Qureshi and others. The FIR filed by the CBI against one of its own was an indication of the escalating turf war between the top officials in the agency. Prior to this, Mr. Asthana filed a complaint against the Director Mr. Verma , accusing him of interfering in a corruption case involving family members of RJD leader Lalu Prasad Yadav. The agency had denied the charges against the Director and said that Mr. Asthana was under probe in half-a-dozen cases and was trying to intimidate officials probing his role. According to top officials, Mr. Verma had briefed the Prime Minister with all the details regarding the bribery case and subsequently, the Prime Minister asked him to meet and brief National Security Adviser Ajit Doval. Asked whether the Prime Minister or the NSA said anything during the meeting, an official said: “Both are concerned about the government’s image getting tarnished in the matter. The NSA asked the Director to lie low and ensure that the government’s image is not damaged in the process.” The official denied that the Prime Minister and the NSA “gave any instruction regarding the case.”

The Curious Case Of Spies Caught Near Exiled CBI Chief's Home

The four men arrested outside exiled CBI chief Alok Verma's home are said to be junior assistant officers of the Intelligence Bureau.

Four officials of the Intelligence Bureau were caught at exiled CBI chief Alok Verma's Delhi home this morning and accused of snooping from parked cars, in continuing drama involving the country's main investigating agency.

In visuals looped on TV channels, the spies stumbled and fought as they were dragged by their shirts by security personnel at Mr Verma's 2 Janpath home (named CBI House since Wednesday night, according to officials). The incident took place around 7:45 am.

That the spies were caught on camera and also arrested, gives a fascinating glimpse into what many would describe as turmoil and disconnect between various agencies. After being handed over to the police, they gave their names -- Dheeraj Kumar, Ajay Kumar, Prashant Kumar and Vineet Kumar Gupta.

In a sharp response, the Intelligence Bureau said there was no snooping and the men had stopped to check on an "unusual collection of people" at the house. Officials said the bureau is responsible for collecting intelligence on situations that may affect public order and internal security.

"(Our) units are routinely deployed on a regular basis in sensitive areas. At times, this is done in association with local law enforcement agencies and at other times, a surprise element is also built in," said officials to NDTV on the inexplicable footage.

Sources said there is a possibility that the men, whose IDs and phones were taken away, were tasked with monitoring Mr Verma's visitors. It would not be unusual.

"This is unlike surveillance, which is done covertly, without any visible appurtenances," the Intelligence Bureau insisted. "One such unit, in early hours of today, halted on Janpath, where there was an unusual collection of people. This was with a view to check the reason why people had collected at the location. This is a high security zone where several protectees reside. Unfortunately, their presence was projected otherwise," said the bureau's statement.

"Would they carry I-cards if they were in covert intelligence?" a top officer said.

Rakesh Asthana, who has been charged in a case filed by the CBI, has also been sent on leave.

When the police -- Mr Verma was Delhi Police commissioner before he became CBI boss -- were called, the men were detained.

On record, the police denied any arrest. "We have not detained anyone," senior officer Madhur Verma told the Press Trust of India.

Despite the Intelligence Bureau's clarification, the strange incident fuelled speculation of surveillance on Mr Verma, who was abruptly sent on forced leave yesterday and replaced by an interim chief, days after he launched an investigation against his deputy Rakesh Asthana, accusing him of corruption.

Mr Asthana, who has been charged in a case filed by the CBI, has also been sent on leave but is seen to have fared better in the CBI bloodbath than his boss. Officers on Mr Verma's team, who were investigating half a dozen charges against Mr Asthana including bribe-taking, were moved out in a mass transfer ordered by M Nageswar Rao, who took over the CBI director's responsibilities around 2 am on Tuesday night.

An Intelligence Bureau operative is overpowered by CBI chief Alok Verma's security guards

The overnight activity took place reportedly under National Security Adviser Ajit Doval's supervision; he set the process in motion by asking for an order divesting Mr Verma of his powers and replacing him with an interim chief. The CBI building was cordoned off around 10.30 pm. The order came out around 1 am and soon Mr Rao drove into the headquarters, escorted by police cars.

The feud between the CBI's top two officers escalated after the agency filed a case against Mr Asthana who has been described as "Prime Minister Narendra Modi's blue-eyed boy" by Congress President Rahul Gandhi.

After 4 men were detained outside Alok Verma's residence, the MHA has denied any snooping angle. MHA sources have said that to snoop on individuals and that too on a senior person as Verma, there are far better techniques. The MHA has termed it a regular patrol, saying several important individuals reside on the same road, including the NSA and former PM Manmohan Singh.

Earlier in the day, four men in plain clothes were detained outside ousted CBI Boss Alok Verma’s residence. In the visuals accessed, the men can be seen running after being confronted by the cops. The detained men have claimed to be the part of the Intelligence Bureau.

Furthermore, Prashant Bhushan has moved Supreme Court seeking quashing of the recent decisions by the centre on the recommendation of the CVC, resulting in the massive CBI overhaul. Bhushan's NGO Common Cause has filed a petition in the top court regarding the two mentioned decisions, as well as also seeking removal of Rakesh Asthana from CBI and an SIT probe into the cases of corruption against the officers of the agency.

The Congress party, meanwhile, has attacked the government over the snooping allegations, saying, “As if the illegal removal of Alok Verma from his post as CBI chief wasn't enough, now the govt. has set IB operatives to spy on him. Not the first time for, #StalkerModi”

Amid row between the number 1 and number 2 at CBI, the Centre on the recommendation of CVC appointed Joint Director M Nageshwar Rao as the interim CBI director in an unprecedented move. Nageshwar Rao took charge as the CBI Interim Director around 2 am this morning, as per the sources.

Both Alok Verma and Rakesh Asthana have been asked to step aside till investigation is complete, as per the recommendation of the CVC. The Superintendence of investigation is under CVC as per the law. The CVC has said that since there are charges and counter charges both have to step aside for a fair investigation. Top government sources have said that those questioning the government decision must clarify whether they want anarchy.

The incident, which took place early in the morning on Thursday, saw four individuals getting caught by the security personnel of the former CBI Director. Upon being caught, the four claimed to be of the Intelligence Bureau (IB), following which Police started their verification process.
