There is no reason in federal law why you would need to be a citizen or lawful permanent resident to play or win a state-run lottery, and it's likely that a state that makes such a rule is in violation of the federal law that prohibits a state from discriminating on the basis of nationality, citizenship, or immigration status.

The reason why they want a green card is because the lottery agency needs a federal tax ID because the winnings from the lottery are subject to US tax. If you win a US-based lottery and are not a "US resident for income tax purposes" (see the Internal Revenue Code), then you will have to pay a raft of additional taxes out of the winnings as the US taxes US-sourced income earned by a nonresident when it leaves the United States. It's likely that, in this situation, the regional lottery disbursement offices cannot handle the transaction, and you'll have to go to the main operational office, with your attorney and other documentation, to sort out all the legal and tax consequences.

The only way to do this is to buy the tickets through a messenger service or lotto agent. This can be done by searching the web for Mega Millions lotto agents, messenger services and concierge ticket pickup services. If you win a jackpot and are not a US citizen you will still get the money through the agent. They will take a fee, the fee may vary from agent to agent but you can rest assured that you will get the money, you may also have to pay taxes, which can be very high. But when dealing with prizes of hundreds of millions of dollars, for a ticket that costs just a few dollars, taxes and fees are not really an issue are they :)

Who Can Play Mega Millions, Powerball, and Other U.S. Lotteries?

Have you ever wondered who can play the lottery? Are you eligible to win if you are not a US resident, but would love to win one of those huge lottery jackpots? Can you buy US lottery tickets if you are from a foreign country? Will you be able to claim the prize money if you win?

Yes, you can buy US lottery tickets and win both the Powerball and the Mega Millions lotteries whether you are a US resident or notWhile there is an age restriction (you have to be at least 18 to play), you can buy tickets in any state which offers the lottery even if you are not a United States citizen, or you don't live in the state selling the ticket, or even if you don't live in the country at all.

And of course, if non-US residents are eligible to buy the tickets, they are also eligible to claim the prize money should they win. However, be aware that the rules covering taxes and withholding vary depending on where you live. Countries outside of the United States might have different procedures. If you do win, be sure to consult with a tax professional for more information.

If you are trying to enter a different type of lottery than the Powerball or Mega -Millions games, check the rules before you enter for eligibility information.
