But problem is there is another rule which says the most current i94 overrides everything else despite it being undercut... idi normal ga evariki thelidu and we assume since we have an extended i94 with the new i797, we are fine. Well technically thats not a illegal thing or that we are not illegal. Its just a stupid rule that confuses a normal person but it should be fine since he has a valid i94 with his i797, albeit being overridden at the poe

yes but h1 extension file chesinapudu they will use the poe i94 too which in this case has expired and is actually the most current one since he travelled into the US after that extended h1

Latest I94 is considered always... If he went out after the 2019 797 was granted and came back with POE I94 as 2017 Oct, he is considered illegal from the end day. He should have requested I94 Extnesion in Oct 2017. Best way now is to go out attend interview and explain honestly aboutthe issue during visa interview.... its all luck thereafter.
