The Maharashtra Assembly today unanimously passed a bill proposing 16 per cent reservation for Marathas.

HIGHLIGHTS

  • They will get 16% quota under socially, educationally backward category
  • Maratha community had launched a huge stir for quota earlier this year
  • Maratha community comprises about 30 per cent of the state's population

Marathas will now get 16 per cent reservation in jobs and education in Maharashtra -- a bill to this effect was passed unanimously today by the state assembly. This 16 per cent reservation is over and above the 50 per cent reservation allowed by the Supreme Court. Currently, 52 per cent seats in Maharashtra are reserved and the Maratha quota will take it to 68 per cent.

Earlier this year, the Marathas, a politically influential community that forms 30 per cent of the state's population, were declared a backward community following their long-standing demand.

The state government led by Devendra Fadnavis took action after protests by the community took a violent turn in July and August.

The upsurge of Marathas, a largely agrarian community to which a large section of Maharashtra politicians belong, had started last year, with its members contending that the politicians had not done much for them. The young brigade claimed because of quota and other benefits, even the Scheduled Castes and Tribes were better off.

The protests, which had started as silent marches, turned violent in July after a 28-year-old man committed suicide. A second protester had made a suicide attempt.

The community hit the road with a vengeance, scheduling frequent bandhs and daylong protests that was accompanied by violence in various pockets.

Arterial roads and train lines were choked, on occasion, vehicles and shops were set ablaze. The Maratha Kranti Morcha, the group spearheading the agitation, even called for the shutdown in Mumbai, the financial heart of the country.

Later, Chief Minister Devendra Fadnavis promised that the government will look into the matter. "A law was made for reservation to the community, but that was stayed by Bombay High Court," Mr Fadnavis said.

Tamil nadu lo already 69% undanta but for that case is going on in supreme court from long time.. First center also has to approve it.

More over the panel which was consistuted to look in to this issue has given its recommendations and way to make it happen.

Marathas have been declared as socially and educationally backward class of citizens (SEBC) and have inadequate representation in services under the state.

They are entitled to reservation benefits and advantages enshrined in the Articles 15(4) and 16(4) of the Constitution, the recommendations mentioned.

Looking at exceptional circumstances and extra-ordinary situations generated on declaring Marathas as socially and educationally backward and their consequential entitlement to reservation benefits, the government may take appropriate decision within constitutional provision to address the emerging scenario in the state, it added.

Asaduddin Owaisi’s AIMIM to Move Court For Muslim Quota as Maratha Reservation Opens Pandora’s Box

Two MLAs – one from Congress and AIMIM each - also raised the demand in the Assembly, but chief minister Devendra Fadnavis immediately rejected it, saying there could be no reservation based on religion.

Mumbai: The Maharashtra government’s decision to award 16 per cent reservation to Marathas has led to demands of quota from other communities.

On Friday, Asaduddin Owaisi’s All India Majlis-e-Ittehadul Muslimeen (AIMIM) said it would move court demanding quota for Muslims in education and government jobs.

The decision to move court was taken after the two MLAs – one from Congress and AIMIM each - raised the demand in the Assembly on Friday, but chief minister Devendra Fadnavis immediately rejected it, saying there could be no reservation based on religion. He advised them to go to the state backward class commission with their demand.

The Maharashtra legislature had on Thursday unanimously passed a bill giving 16 per cent reservation to the Marathas. This 16 per cent reservation is over and above the 50 per cent reservation allowed by the Supreme Court. Currently, 52 per cent seats in Maharashtra are reserved and the Maratha quota will take it to 68 per cent.

The AIMIM said Muslims, too, deserve benefits of the reservation system as they have "lived for generations in poverty."

Party legislator Imtiyaz Jaleel said he doesn’t expect anything from this "anti-Muslim government" and their only hope is the judiciary.

"Do they think Muslims live in palaces or mansions? If Marathas are given reservation, Muslims should be given reservation too. What are the criteria on which Marathas have been given reservation? That 93 per cent of them have income below 1 lakh? That is ridiculous,” he said.

In a tweet, Owaisi, also said that depriving backward Muslims of their fair share in public employment and education was a grave injustice. "I have consistently argued that there are backward castes in Muslims who have lived for generations in a cycle of poverty. Reservation is a tool that will break this cycle," he stated.

Jaleel further said Muslims’ demands for 5 per cent reservation in education was endorsed even by the High Court. He said the "hurriedly" passed Bill for reservation to Marathas mentions the backwardness of the community on the basis of findings by a government-appointed commission.

"Going by the same logic, the plight of Muslims who have been regarded as socially, educationally and economically backward by three commissions - the Sachhar Commission, the Ranganath Mishra Commission and the Mehmood Rehman commission - should also have been given the same benefits as those being given to Marathas," he said.

Patidar leader Hardik Patel has also asked Thursday why the BJP government in Gujarat can’t take the same step for his community.

He sought a survey to establish social and economic backwardness of Patidars, on the lines of a survey ordered by the BJP-led Maharashtra government for the Maratha community.

"No such survey was done in Gujarat. The survey would prove that Patidar community is socially and economically backward," he said.
