Questions filling H-4 form (Change of status: F1 to H4)

Hi all,

Could anyone please give the complete check list for applying H4 and H4 EAD.

Also have few questions & need help with filling H4 (I-539 - Change of status: F1 to H4) and H4 EAD for my sister.

-----------------------------------------------------------------------------------------------Form I-539 Questions-----------------------------------------------------------------------Question 1: My sister is on F-1 OPT and stopped working one month back and he will be filing now for change of status from F1 to H4.

i) So will there be any issues meaning my siser is still on valid status? (Her F1 visa validity is till June, 2019)

ii) Will she get I94 on her H4 approval? does she have to go for stamping (my sister's spouse has valid I94 on H1B)

Question 2: What should be the new status effective date of change in 2.a? Can she request for example January 1, 2019 or the last date of her current visa? 

2.a - "A change of status. The new status and effective date of change. (mm/dd/yyyy)"

Question 3:  Part3: In 1.a, have to give the end date on my sister's spouse's H1B approval? And In 1.b, have to select the checkbox?

1.a. "I/We request that my/our current or requested status be extended until (mm/dd/yyyy)"

1.b. "Check this box if you were granted, or are seeking, Duration of Status (D/S)."

Question 4: In part 3, from 3a to 3f, all of them we will be empty if my sister's spouse already has H1B approved correct?

Question 5: My sister is changing from F1 to H4 and worked on OPT. Currently, she is not working. So for below question I should select Yes?

19. Have you, or any other person included in this application, been employed in the United States since last admitted or granted an extension or change of status?

COS apply chesi if we get receipt then she will be in valid status kadha?

India ki velli stamping ante still we have to apply for H4 kadha what is the difference?

Status valid but 294 days rule untadhi I-94 expire aithe you are in trouble. Simple H4 ki Canada velli stamping tisukovochu kada or go India for a vacation.

artham kaaledhu mama, H4 stamping ki Canada vellali ante H4 approve avvali kadha first? COS apply cheyyakunda is there other way? COS kakunda aina H4 ki apply cheyyyali kadha?

 

are you saying that applying for H4 directly instead of COS is better way?

india vellu h four mida ravachu..so  u can get it in 1-2 weeks also depending on return travel...thats the fastest way....

US lo COS ante takes time...

india velli .. consulate lo H4 visa ki interview attend ayyi..ravachu.. its easier and quicker option

H4 ki kuda rejections a??       should be easier than other type of visas... check murthy or trackitt for recent interview experiences
