02/15/2019: President Signed FY 2019 Spending Bill Along w/National Emergency Declaration

• No government shutdown! What other immigration provisions are attached other than H-2B? We will find out soon.
• What a relief for EB-4 Non-Minister Religious Worker Immigrants and EB-5 Investment Immigrants! March 2019 Visa Bulletin provided that the programs will be valid only until 02/14/2019, but should the spending bill be passed timely, the EB-4 and EB-5 visa numbers will be restored current and these immigrants could obtain 485 applications as well as new 485 filings for the rest of the year!! Amen.
• Emergency Declaration may be challenged in the federal court, but the result of the lawsuit will not affect the spending bill and involved immigrants will not be affected no matter what with the result of the lawsuit.

 

02/17/2019: Immigration Programs Extension Until 09/30/2019 Under FY 2019 Spending Bill

• Division H, Title I (page 1160 - 1161) exended the following immigration provisions:
  • 8 USC 1324a (IIRAIRA)
  • 8 USC 1101(a)(27)(C)(ii) (II) and (III) Non-Minister Special Immigration Program
  • 8 USC 1182 Excludable Aliens
  • 8 USC 1153 Allocation of Immigrant Visas, including EB-5 Investment Immigration
  • 8 USC (a)(15)(H)(ii)(b). H-2B Non-Agricultural Temporary Worker Special Allocations
• A report indicates that VAWA relief appears to have failed to get extension. A reader asked whether H.R. 1044 was included in the final spending bill. It appears the legislative bill was not a part of negotion in the final spending bill.
